04-1213Council File # o� � Green Sheet # 3024592 RESOLUTION SAINT PAUL, MINNESOTA Presented By 3b Re£erred To \ / Committee: Date December S, 2004 1 WI3EREAS, Neighborhood Housing and Properry Improvement (NHPn has requested the City 2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate 3 for a duplex rental properiy located at 517 MINNEHAIIA AVE E and registered to Kenneth K. 4 Krahn/Co First Choice Rental; and 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2Q 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 WHEREAS, on August 18, 2004, NHPI conducted an inspection of said properry and issued a Correcrion Notice with a compliance deadline of September 23, 2004; and WHEREAS, on October 8, 2004, NHPI conducted a reinspection of said properiy and found lack of compliance with the previous order; and WHEREAS, on October I 1, 2004, NHPI sent the holder of the rental registration certificate for the subject properiy, Kenneth K. KrahnlCo First Choice Rental, a$50 excessive consumption bill, addressed to 6856 48th Piace N, Oakdale MN 55128-2000,the address on said certificate;and WHEREAS, as of November 22, 2004, said $50.00 has not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation; and WIIEREAS, on October 11, 2004, NHPI notified Kenneth K. Krahn/Co First Choice Rental of the need to arrange an interior inspection of the subject property; and WHEREAS, as of November 22, 2004, an interior inspection has not been arranged, and Legislative Code §51.07 (a) (iii) provides that the imposition of an excessive constunption fee is grounds for aninterior inspection; and WHEREAS, on November 22, 2004, NHPI sent Kenneth I� Krahn/Co First Choice Rental the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, Kenneth K. KrahnlCo First Choice Rental has not appealed said notace and the time for filing an appeai has expired; now therefore BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following fmdings and arder concerning the subject property at 517 MINNEFIAI3A AVE E. � 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 l. I am writing to you in your capacity as the hoider of a rental registration certificate for 517 MINNEHAHA AVE E, St. Paul MN. You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative Code, of the City's intent to revoke the registration certificate far 517 MINNEHAHA AVE E based on the following: 1. 2. 3. 4. 5. 6. On October 11, 2004, this deparhnent sent you a$50.00 bill for the cost of said reinspection. As of today this $SQ.QO has not been paid. On October 11, 2004, this department notified you by mail of the need to arrange an interior inspection of said rental properry. As of today this interior inspection has not been arranged. I have referred this matter to the St. Paul City Council with a recommendation to revoke the rental registration cerCificate. The City Council will revoke unless an appeal is filed in the next thirteen (13) days from the date of this notice. An appeal may be filed pursuant to legislative Code § 18.02, by appearing in person between the hours of 8:00 a.m. and 430 p.m. on any business day at the City Clerk's Office, Room 170, City Hall, 15 W. Kellogg Boulevard, St. Paul, MN or you may appeal by mail within the same 13 day time line. Once the City Council has revoked the rental registration certificate, occupancy of the pxoperty is not allowed AA-ADA-EEO P,mployer ., _ D�f- i�3 until (1) an inspection by Neighborhood Housing and Properry Improvement (NHPI) has been conducted, (2) the Director of NI3PI has determined the property to be in compliance, and (3) the certificate is renewed. Note: Renting a properiy without a certificate is a misdemeanor. Piease call me as soon as possible to anange a meeting to discuss how to conect this situarion before the City Council acts to revoke this certificate. If all issues aze addressed, I will recommend that the revocation be withdrawn from consideration by the City Council.
