3 for a single family rental property located at 1173 MARGARET ST and registered to Kong Xiong; and

WHEREAS, on August Z5, 2004, NHPI conducted an inspection of said property and issued a
Correction Order with a compliance deadline of September 3, 2004; and
WFIEREAS, on September 8, 2004, NHPI conducted a reinspection of said property and fo�uid
lack of compliance wlth the previous order; and
WHEREAS, on September 4, 2004, NHPI sent the holder of the rental registration certificate for
the subject properiy, Kong Xiong, a$SQ excesive consumption bill, addressed to 1259 Arkwright St, St
Paul MN 55101-3503, the address on said certificate; and
WFIEREAS, as of November 19, 2004, said $50.00 has not been paid, and Legislative Code
§51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate
revocation; and
WHEREAS, on September 9, 2004, NHPI notified Kong Xiong of the need to arrange an
interiorinspection ofthe subject property;and
WHEREAS, as of November 19, 2004, an interior inspection has not been arranged, and
Legislative Code §S I.Q7 (a) (iii) provides that the imposition of an excessive consumption fee is grounds
for an interior inspection; and
WHEREAS, on November 19, 2004, NHPI sent Kong Xiong the proper Notice of Intent to
Revoke Rental Registration (copy attached); and
WI3EREA5, Kong Xiong has nof appealed said notice and the time for filing an appeal has
expired; now therefore
BE IT RESOLVED, that based on the faregoing, the Saint Paul City Council hereby adopts the
following findings and order concerning the subject properiy at ll 73 MARGARET ST .
That the subject properiy is a singie family rental property that is required to be registered
with the City's Rental Registration Program.

2. That the holder of the Rental Registration Certificate for the subject property is Kong
Xiong .
That said certificate holder has been biiled for excessive consumption of code inspecfion
services, which has not been paid.

Thax said certificate holder has been requested to allow an interior inspecfion of the
subject property, which has not been arranged.
�
That the nofificafion requirements of Chapter 51 have been fulfilled and the time for an
appeal has expired without an appeai being made.

ORDER
The Saint Paul City Council hereby makes the following order:
The above-referenced Rental Registration Certificate issued to Kong Xiong for the single
family rental property at 1173 MARGARET ST , Saint Paul, MN is hereby revoked.

It is fiuther ordered that a copy of this resolurion be mailed to Kong Xiong.

I am writing to you in your capacity as the holder of a rental registration certificate for �1173 MARGARET ST
St. Paul MN.
You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative
Code, of the City's intent to revoke the registration certificate for 1173 MARGARET ST based on the
following:
On August 25, 2Q04, this department conducted an inspection of said property and issued a
Correction Order with a compliance deadline of September 3, 2004.

Qn September 8, 2004, this department conducted a reinspection of said property and found lack
of compliance with the pzevious order.
On September 9, 2004, this department sent you a$50.00 bill for the cost of said reinspection.
As of today this $50.00 has not been paid.
On September 9, 2004, this department notified you by mail of the need to arrange an interior
inspection of said rental property.
As of today this interior inspection has not been arranged.
I have referred this matter to the St. Paul City Council with a recommendation to revoke the rental registration
certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13) days from the_ date of
this notice. An appeal may be filed pursuant to legislative Code §18.02, by appearing in person between the
hours of 8:00 a.m. and 430 p.m. on any business day at the City Clerk's Office, Room 170, City Hall, 15 W.
Kellogg Boulevazd, St. Paul, MN or you may appeal by mail within the same 13 day time line.

Once the City Council has revoked the rental registration certificate, occupancy of the properiy is not allowed
until (1) an inspection by Neighborhood Housing and Property Ixnprovement (NHPI) has been conducted, (2)
the Director of NFIPI has determined the properry to be in compliance, and (3) the certificate is renewed. Note:
Renting a property without a certificate is a misdemeanor.
Please call me as soon as possibie to arrange a meeting to discuss how to correct this situation before the City
Council acts to revoke this certificate. If ali issues aze addressed, I will recommend that the revocation be
withdrawn from considerafion by the City Council.
