2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate
3 for a duplex rental properiy located at 301 LAFOND AVE and registered to Chao Lee(Chao Pha; and

WHEREAS, on August 23, 2Q04, NHPT conducted an inspection of said property and issued a
Correction Notice with a compliance deadline of August 31, 2004 for Items #1, #2, #3; and

WI3EREAS, on September 3, 2004, NHPI conducted a reinspection of said property and found
lack of compiiance with the previous order; and
WHEREAS, on September 7, 2004, NHPI sent the holder of the rental registration certificate for
the subject property, Chao Lee/Chao Pha , a$50 excessive consumption bili, addressed to 16191 Apine
Way, Fden Prairie MN 55346, the address on said certificate; and
WIIEREAS, as of November 19, 2004, said $50.00 has not been paid, and Legislative Code
§51.06 (a) (v) provides that non-payment of fees for excessive consumption is g�ounds for certificate
revocation; and
WHEREAS, oii September 7, 2004, NHPI notified Chao LeelChao Pha of the need to arrange
an interior inspection of the subject property; and
WHEREAS, as of November 19, 2004, an interior inspection has not been arranged, and
Legislative Code §S 1.Q7 (a) (iii) provides that the imposition of an excessive consumption fee is grounds
for an interior inspection; and
'WIiEREAS, on September 15, 2004, NHPI conducted another reinspection of said property and
found lack of compiiance with the previaus order; and
WHEREAS, on September 16, 2004, NHPI sent the holder of the rental registration certificate
far the subject property, Chao LeefChao Pha, a$75 excessive consumption biil, addressed to 1619 ]
Apine Way, Eden Prairie MN 55346, the address on said certificate; and
WHEREAS, as ofNovember 19, 2004, said $75.00 has not been paid, and Legislative Code
§51.06 (a) (v) provides that non-payment of fees for eYCessive consumption is grounds for certificate
revocarion;and
WHEREAS, on November 19, 2004, NHPI sent Chao LeeJChao Pha the proper Notice of Intent
to Revoke Rental Registration (copy attached}; and
WI�EREAS, has not appealed said notice and the time for filing an appeal has expired; now
therefore

BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
foliowing findings and order conceming the subject property at 301 LAFOND AVE .

The Saint Paul City Council hereby makes the following order:
That the subject property is a duplex rental properiy that is required to be registered with
the City's Rental Registration Program.
That the holder of the Rental Registration Certificate for the subject property is Chao
Lee/Chao Pha.
That said certificate holder has been billed for excessive consumption of code inspection
services, which has not been paid.
That said certificate holder has been requested to allow an interior inspection of the
subject properiy, which has not been arranged.
That the notification requirements of Chapter 51 have been fulfilled and the rime fox an
appeal has expired without an appeal beang made.
1. The above-referenced Rental Registration Certificate issued to Chao LeeJChao Pha for
the single family rental property at 3Q1 LAFOND AVE., Saint Pau1, MN is hereby
revoked.
2. It is fitrther ordered that a copy of this resolution be mailed to Chao Lee/Chao Pha .

I am writing to you in your capacity as the holder of a rental registration certificate for 301 LAFQND AVE ,
St. Paul MN.
You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative
Code, of the City's intent to revoke the registration certificate for 301 LAFOND AVE based on the following:

On August 23, 2004, this deparhnent conducted an inspecfion of said property and issued a

On September 3, 2004, this department conducted a reinspection of said property and found lack
of compliance with the previous order.
On September 7, 2004, this department sent you a$50.00 bill for the cost of said reinspection.
As of today this $50.00 has not been paid.
On September 7, 2004, this depariment notified you by mail of the need to anange an interior
inspection of said rental properiy.
On September 15, 2004 this department conducted another inspection of said properiy and found
lack of compliance with the previous order.
On September 16, 2004 this departrnent sent you a$75.00 bill for the cost of said reinspection
As of today this $75.00 has not been paid.

9. On September 16, 2004 this department notified you again by mail of the need to anange an
interior inspection of said rental property.
10. As of today this interior inspecrion has not been arranged.
I have referred this matter to the St. Paul Ciry Council with a recommendation to revoke the rental rea stration
certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13} days from the date of
this notice. An appeal may be filed pursuant to legislative Code § 18A2, by appearing in person between the
hours of 8:00 a.m. and 430 p.m. on any business day at the City Clerk's Office, Room 170, City Hall, 15 W.
Kellogg Boulevard, St. Paul, MN or you may appeai by mail within the same 13 day time line.
Once the City Council has revoked the rentai registration certificate, occupancy of the property is not allowed
until (1) an inspection by Neighborhood Housing and Property Improvement (NHPI) has been conducted, (2)
the Director of NHPI has determined the properry to be in compliance, and (3) the certificate is renewed. Note:
Renting a properiy without a certificate is a misdemeanor.
Please call me as soon as possible to arrange a meeting to discuss how to correct this situation before the City
Council acts to revoke this certificate. If all issues aze addressed, I will recommend that the revocation be
withdrawn from consideration by the City Council.
