WHEREAS, Neighborhood Housing and Properry Improvement (NHPI) has requested the City
Council to hold public hearings to consider the advisability of revoking the rental registration certificate
for a single family rental property located at 1 Q24 CENTRAL AVE W and registered to BeverlylCalvin
Burton; and
WHEREAS, on August 23, 2004, NHPI conducted an inspection of said property and issued a
Conection Notice with a compliance deadline of September 3, 2004; and
WHEREAS, on September 15, 2004, NHPI conducted a reinspection of said property and fotmd

lack of compiiance with the previous order; and
WHEREAS, on September 16, 2004, NHPI sent the holder of the rental registration certificate
for the subject properry, BeveflylCalvin Burton, a$50 excessive consumption bill, addressed to 362
Ruthie Lane, Hudson WI 55016, the address on said certificate; and
16 WHEREAS, as of November 22, 2004, said $50.00 has not been paid, and Legislative Code
17 §51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate
18 revocation; and

20 WI IEREAS, on September 16, 2004, NHPI notified BeverlylCalvin Burton of the need to
21 arrange an inteiior inspection of the subject property; and

23 WHEREAS, as ofNovember 22, 2004, an interior inspection has not been arranged, and
24 I,egislative Code §51.07 (a) (iii) pxovides that the imposition of an excessive consumption fee is grounds
25 for an interior inspection; and

WIIEREAS, on November 22, 2004, NHPI sent BeveriyCalvin Burton the proper Notice of
Intent to Revoke Rental Registration (copy attached); and
WFIEREAS, Beverly/Calvin Burton has not appealed said notice and the time for filing an appeal
has expired; now therefore
BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
following findings and order concerning the subject property at 1024 CENTRAL AVE W.
That the subject pTOperty is a single family rental pxoperty that is required to be registered

with the City's Rental Registrarion Program.

Beverly/Calvin Burton.
That said certificate holder has been billed for excessive consumption of code inspection
services, wluch has not been paid.
That said certificafe holder has been requested to aliow an interior inspection of the
subject properry, which bas not been arranged.
1"nat ihe nofification requirements of Chapter 51 have been fulfilled and the time for an
appeal has expired without an appeal being made.

The Saint Paui City Council hereby makes the following order:

I am writing to you in your capacity as the holder of a rental registration certificate for 1024 CENTRAL AVE

You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative
Code, of the City's intent to revoke the registration certificate for 1024 CENTRAI, AVE W based on the

On August 23, 2004, this deparhnent conducted an inspection of said property and issued a
Correction Notice with a compliance deadline of September 3, 2004
On Septembex 15, 2004, Chis department conducted a reinspection of said properiy and found
lack of compliance with the previous order.
On September 16, 2004, this department sent you a$50.00 bill for the cost of said reinspection.
As of today this $50.00 has not been paid.
On September 16, 2004, this department notified you by mail of the need to arrange an interior
inspection of said rental properry.
As of today this interior inspection has not been arranged.
I have referred this matter to the St. Paul City Council with a recommendation to revoke the rental registration
certificate. The City Council will revoke unless an appeal is filed in fhe next thirteen (13) days from the date of
this notice. An appeal may be filed pursuant to legislative Code § 18.02, by appearing in person between the
hours of 8:00 a.m. and 4:30 p.m. on any business day at the City Clerk's Office, Room 170, City Hall, 15 W.
Kellogg Boulevazd, St. Pau1, MN or you may appeal by mail within the same 13 day time line.

Once the City Council has revoked the rental registrafion certificate, occupancy ofthe property is not allowed
until(1) an inspection by Neighborhood Housing and Properiy Improvement (NHI'n has been conducted, (2)
the Director of NHPI has determined the property to be in compliance, and (3) the certificate is renewed. Note:
Renting a properiy without a certificate is a misdemeanor.
Please call me as soon as possible to arrange a meeting to discuss how to conect tlus situation before the City
Council acts to revoke this certificate. If all issues are addressed, I will recommend that the revocation be
withdtawn from consideration by the City Council.
