PAUL OOE NCIL NO. ���`��� M OFFICE OF THE CITY CLERK ' OUNCIL RESOLUTION-GENERAL FORM PRESENTED BY COMMISSIONE �� DA7F In the Matter of a hazardous building being that two-story two- family frame dwelling known and described as 814 Ocean Street in the City of Saint Paul and situated upon those premises legally des- cribed as Lot 5, Block 1, Messerli and Eschbach' s Addition, according to the plat on file and of record in the office of the Register of Deeds in and for the County of Ramsey, State of Minnesota. WHEREAS, Pursuant to resolution, C. F. No. 241402, approved December 20, 1968, a public hearing was duly held on Thursday, January 2, 196g, before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structure located at 814 Ocean Street , Saint Paul, Minnesota; and WHEREAS, Upon the facts presented at the said hearing consisting of photographs, inspection reports and the recommenda- tion of the Gity Architect, it is found and determined by the City Gouncil that according to the records and files in the offiee of the Register of Deeds, the last record owner of the above- described p�operty is August Lang; and that there are no other lien holders of record; and that it is further determined that the above-described building constitutes a hazardous building within the d�inition of Minnesota Statutes Section 463.15 for the following reasons : a. The exterior condition of the building is as follows: the front and rear porches are in a dilapidated condition with the supporting posts showing evidence of being rotted or pushed out of position due to sagging; the posts support- ing a rear second story porcY�. are badly out of place and the platform is sagging; the stairway to the second �loor porch has deteriorated with the treads badly worn, and one of the risers is missing; a shed-type lean-to addition at the side of the buildin.g has the siding material only partially in place, and this consists of roof shingles used for side wall covering; the roofing on the rest of the building is badly deteriorated, the rear half of the roof has several sections and shingles ma:ssing; all of the windows are smashed and in many cases the window frames and sash are also smashed; c. The interior condition of the building is as follows : doors between the rooms have been. torn from the walls ; most of the walls are covered with an insulating board; in many areas the walls have holes punched through them an.d the insulation board torn from the wall ; the entrance to the attic is by scuttle hole to storage area; most of the plumbing fixtures have been broken or removed; the electrical fixtures and switches have been vandalized; there is no heating system in the building; and there is a14x18 foot garage which is in a dilapidated condition and should be removed; d. The building in the above condition is beyond reasonable repair; e� The building is unfit for human habita- tion in its present condition and the above correction.s must be made in compliance with the Building Code and the Housing Code of the City of Saint Paul in order to make the same habitable; � � . � , • '�= ���_u��_Afl Page 3. f. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical damage, dilapidation and inadequate m�.tenance; now, therefore, be it RESOLVED, That in aceordance with Minnesota Statutes Sections 463. 15 through 463. 26, and based upon the foregoing findings of the City Council , the Council of the City of Saint Paul does hereby make the following Order: ORDER l. The owner of the above—described building shall make the same safe and not detrimental to the public peace, health, safety and welfare by having the said buildin.g razed and the materials therefrom removed from the premises within thirty (30) days from the date of the service of this Order� 2. Un.less such corrective action is taken to comply with this Order or an answer served upon the City of Saint Paul and filed in the Office of the Clerk of the District Court of Ramsey County, Minnesota, within twenty (20) days from the date of the service of this Order, a Motion for Summary Enforcement of this Order to raze and remove the said building will be made to the Ramsey County District Court; 3. In the event that the building is to be razed by the City of Saint Paul pursuant to judgmen.t of the District Court , all person.al property or fixtures which may unreasonably inter�ere with the razing and removal of this building shall be removed within ten (10) days from the entry of judgmen.t ; an.d if not so removed, the City of Saint Paul shall remove and dispose of such personal proper— ty and �ixtures as provided by law; OR161NAL� CITY CL6RK 2�{� ' ��� ,. Byrne, Mayor and Members of the City Council Re: File No. 1965--814 Ocean Street Gentlemen: The Build.ing Department is hereby submitting its report on the condition of the property known as 814 Ocean Street, a duplex of frame construction, two stories in height and containing only a small hole for a basement. It is approximately 24 ft. wid.e, 53 ft. long and 30 ft. high. The property has been board.ed up by the Public Works crews since it had been standing open and was extensively vandalized. The legal description of the property is Lot 5, Block 1, Messerli and Eschbach's Addition, and the owner of record, is the deceased August Lang. A recent inspection indicates the following: EXTERIOR. The front and rear porches are in a very dilapid.ated. condition with the supporting posts showing evidence of being rotted or pushed. out of position due to sagging. The posis supporting a rear second. story porch are badly out of place and. the platform is sagging. The stairway to the second floor porch has d.eteriorated with the treads bad.ly worn, and one of the risers is missing. A shed-type lean-to ad.d.ition at the side of the build.ing has the siding material :only partially in place � and this consists of roof shingles used for side wall covering. All of the windows are smashed. and in many cases the window frames and sash are also smashed, FIRST FLOOR, Contains five rooms. The doors between the rooms have been torn from the walls. Some of the walls are plaster finish, but most of them are covered with an insulating board. In many areas the walls have had. holes punched through them and the insulation board torn from the wall. There is no heating system in the building. There is a 14x18 ft. garage, which is in a dilapidated condition and which should be removed. Inasmuch as a rehabilitation shcedule has not been submitted. by the owner, it is the conclusion of the Bureau of Public Build.ings that by reason of inad�quate maintenance, dilapidation, physical d.amage, unsanitary condition and. abandonment, the above structures constitute a hazard to public health, safety and welfare. It is hereby recommended that the Council concur in this conclusion and refer the matter to the City Attorney's office for submission of this condemnation to the District C ourt. er tru urs .
