of 60 ft. from N. Hamline Ave. to 701 ft. W'ly; NORTH ALBERT STREET from
the proposed opening of Brewster St. to the proposed opening of W. Jessamine
Ave. ; Section 27, Township 29, Range 23. Easemehts necessary to the
construction of the "HAMLINE AVENUE STORM SEWER, CONTRACT A."
The order to open, widen and extend the abave streets comes before the
Council based on a letter ftom Mr. Ciayton G. Rein, President of the C. G.
Rein Company. Mr. Rein owns the majority of the property at the above
area. On November 28� 1g57, a hearing was held as to the advisability of
opening these streets. However, the plan at that time was somewhat more
< extensive in nature. Jessamine, at that time, extended all the way
` through from Hamline to Snelling, abutting the property of the Cotumbia
Transit Company and the Northern Pacific Raiiroad. At that time, these
hearings were held over numerous times because of legal complications
, that I 'm sure the Counctl is aware of, and the last final hearing was held
on February 13, 1968. At that hearing a petition of remonstrance was -
presented by the Coiumbia Transit Company� the Northern Pacific Railroad
', and other owners and because the Council d1d not dectare it a public
necessity, no vote was taken and the order automattcal)y died. Mr. Rein,
in his letter dated February 16, 1968, suggested Che madified layout of
the area and a pTan� which we believe would be more acceptable to both
the Northern Pacific Railroad and the Columbia 7ransit Company. A copy
of this plan is attached. Also inciuded in the above order is a sewer
easement necessary for the construction of the Hamline Avenue Sewer �
Contract A. A copy of this sewer easement is also attached. it is the
: opinion of the Engineers of the Pubiic Works Department that this plan
is necessary for the development of this area. The Engineering
Recanmendation Is for passage of the order as written, the opening arders ,(,y
