THE COUNCIL OF THE CIlY OF SAINT PAUL DOES ORDAIN:
Section l. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining to Use
Districts, Height Districts and Rezoning of certain properties
in the City of Saint Paul, as amended, be and the same is hereby
further amended so as to rezone the following described property
from "A" Residence District to Commercial District, to--wit:
The south 15 feet o� Lot 11, Lots 12, 13, 14, 15,
16, Nilsson' s Subdivision of Lots 9 and 10, Block
4, Rogers and Hendrick� s Aere Lots #2;
situate on property located at the northeast corner of Maryland
and Prosperity Avenues in the City of Saint Paul.
Section 2. This ordinance shall take effect and be in force
thirty (30) days from and after its passage, approval and publica-
tion.

Dear Sir:
This is written in response to the petition of Harold M. Larsen to
rezone from "A" Residence to Commercial,property located on the northeast
corner of Maryland and Prosperity Avenues. This property is described as
the south 15 feet of Lot 11, Lots 12, 13, 14, 15, 16, ililsson's Subdivision
of Lots 9 and 10, Block 4, Rogers and Hendrick's Acre Lots #2. It is
proposed to develop the site with a bank and related parking.
This matter was considered at the November 21, 1968 Board of Zoning
meeting. The staff reported that past zoning actions have set a precedent
in changing the character of Maryland Avenue. However, the following items
were noted against the rezoning: 1) the proposal represents spot zoning;
2) the Traffic and Accident Section of the Police Department recommends
that no comanercial establishment be permitted on this site which would
increase left turns off Maryland Avenue; 3) the proposal would increase
proliferation of an already sprawling commercial development in this area;
4) tne area contains large commercial and industrial zoned areas that are
vacant; 5) Comr�rcial use will have an adverse effect on adjacent single-
family homes; and 6) the bank facility is already located nearby in a suit-
ably zoned area. The representative of the bank stated that the neighbors
are in favor of the development, the proposed facility would not add to the
traffic on the street as bank customers would come primarily from the area
north of Maryland Avenue, and that the alley would be used as an entrance
to the proposed facility with traffic exiting to Prosperity Avenue away from
�Iaryland
After subsequent discussion, the Board of Zoning voted to recommend
approval of this petition to rezone from "A" Residence to Commercial.

to the south is zoned Commercial (Phalen Center). One to four blocks to the
west are several areas zoned for apartments, commercial, and industrial uses.
F. COMPREHENSIVE PLAN: Recommends R-3, single family for the area north of Maryland
Avenue; R-6, up to 25 D.U. per acre along the south side of Maryland Avenuec
G. S1TE_COVDITIONS: Site is vacant except for older single family residence on
east portion. The site is divided by an unimproved alley. The site slopes
to the southwest and is 3' to 7' above the grade of Maryland Avenue with the
east portion considerably higher than the remainder of the site.
H. AREA CONDITIONS: The immediate area and that to the north is developed residential,
predominantly single family. Higher uses exist to south and west.
