Lentsch to re- zone from "B" residence and Commercial to "C" residence property located on the east side of Western Avenue between Jessamine and Geranium Avenues and further described as Lots 11 and 12, Bloc1� 18, Auerbach and Hand's Addition. � This matter was considered at the April 17, 1969 Board of Zoning meeting. The staff reviewed the zoning history and summarized the staff investi- gation. The following conclusions were noted: "C" residence for this site would be "spot" zoning; rezoning to "C" residence would amount to tacit approval of the pending appeal for a nine-unit apartment; the Com- prehensive Plan recommends one and two-family development for the area; "C" residence permits 25% floor area of one floor to be developed with co�aanercial uses plus the allowable number of units. Discussion followed by the Board, staff, and Mr. Paul Kelly of the Cor- poration Counsel's office, on the procedures to be used in handling this rezoning and the related appeal. Subsequently it was the finding of the Board that this petition to re- zone from "B" residence and commercial to "C" residence �ould be granted. Mr. Sorenson outlined the matter as followa: an appeal for the extension of comnercial use for the entire site was granted and an appeal for the relaxation of density standards to permit development of the aite with 9 units was denied on April 17, 1965. An administrative parkiag lot was approved on April 2, 1965. An appeal dated November 13, 1968 requested a relaxation of deasity standards to perwit nine dwelling units on a sYte that permitted 7 dwelliag units after the Citg Council grsnted an extension of we under 5ection 64.03 par. "a" under the Legis- lativ� Code on April 17, 1965. The extet�sion of use appeal, however, gru►ted by � the Council in 1%5 expired on April 17, 1968. The legal opinion from the Cor- ; �poration Counsel's office, dated March 6, 1958, states that the City Council : could no longer extend a use permitted in one zoning district to another. Mr. � Lentach was unaware of the expirstion of hie appeal and applied for a building per- `t mit for a 7-unit apartment building wfth apace for two business establish�nents. Lentsch to re-zone from "B" Residence and Commercial to "C" Residence.property located on the east side of Western Ave- nue between Jessamine and Geranium Avenue. This property is further described as Lots 11 and 12, Block 18, Auerbach and Hand's Addition. The Board of Zoning considered this matter at its April 17, 1969 meeting. It was their conclusion and recommendation that this re-zoning and an appeal also dealing with the same property be considered at the same time. The Board of Zoning at this meeting.considered and made recommendations on both matters. The request of the Finance Department to schedule a Council hearing, however, mentioned bnly the re-zona�ng and therefore notices to surraunding property owners did not mention the appeal. Because of the unusual nature of these matters the Zoning Board feels that the Council public hearing should cover both t�e re-zoning and the appeal. It is also requested, therefore, that new notices be sent to surrounding property owners notifying them of a re-scheduled hearing on the re-zoning and of a hearing to be held at the same time on the appeal.
