RESOLUTION AUTHORIZING CARRYFORWARD OF
i_iNiJSED PRIVATE ACTIVITY BOND VOLiJME CAP
6 WHEREAS, the City of Saint Paul, Minnesota (the "City") is an"entitiement issuer" within the meaning
7of Minnesota Statutes, Section 474A.02, subd. 7; and

9 WHEREAS, the City's entitlement allocation for 2004 under Minnesota Statutes, Chapter 474A.03, subd.
102a(3) is $27,304,000; and

WHEREAS, the City expects to issue bonds attributable to such allocation in the amount of $6,$98,180;
WHEREAS, the City expects to have unused entitlement allocation for 2004 in the amount of $20,405,820;
18 WHEREAS, the City may, under § 146( fl of the Internal Revenue Code of 1986, as amended, and under
19Minnesota Statutes, Chaptex 474A, "carryforward" all or aportion ofthe City's unused enritlement allocation for
20the year 2004; and

22 WHEREAS, it is in the best interest of the public health, safety and welfare that the City canyforward for
23qualified carryforwazd purposes any 2004 entitlement allocation remaining unused on December 31, 2004

25 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Saint Paul, Minnesota, as
26follows:

28 1. The City hereby elects to carryforward $5,600,000 for qualified mortgage bonds and the remainder
29of any part of its 2004 entitlement allocation which remains unused at the end of 2004 for the purpose of qualified
30residential rental bonds.

32 2. The City's Director of Planning and Economic Development is hereby authorized and directed to
33file with the Internal Revenue 5ervice a Form 8328 specifying the amount of entitlement allocation to be carried
34forward as described above. The Form 8328 shall be filed with the Intemal Revenue Service on or before
35February 15, 2005. The City directs the Director to notify the Minnesota Deparhneirt of Finance of the specific
36amount of such carryforward at such time and as required by Minnesota Statutes, Chapter 474A.

38 3. Any amount carried forward for the purposes of qualified residential rental bonds may be utilized
39by the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (the "Authority") pursuant

lto a multifamily housing finance program approved by the City pursuant to Minnesota Statutes, Chapter 462C.
2The Authority may, at its option, delegate its authority to issue bonds pursuant to the carryforward elecfion to the
3Minneapolis/Saint Paul Housing Finance Board. The proceeds of bonds issued by the Minneapolis(Saint Paul
4Housing Finance Board may be applied without regard to jurisdictional boundaries as provided in Mnuiesota
SStatutes, Section 462C.12, subd. 3.

At the end of each yeaz, Yhe State of Minnesota and the IRS require that the City "carryforwazd" any portion of the City's unused
bonding entitlement allocarion which can be used in the following year. This yeaz's deadline is December 31, 2004.
