RESOLVED, Upon the pertinent appeal , under the Zoning
Code, by the Kellogg Square Company and the Housing and
Redevelopment Authority of the City of Saint Paul, owners of
the subject premises, zoned in Commercial and Light Industry
District, under said Zoning Code, described as Block 25,
Saint Paul Proper, according to the plat thereof on file and
of record in the office of the Register of Deeds in and for
the County of Ramsey, Minnesota, that the provisions of
said Zoning Code, in respect to density and lot coverage
requirements, hereby are determined and varied, in their
application to said real estate, as and to the extent
necessary therefor, an.d that a permit hereby is granted unto
said appellants, and their successors in interest, in respect
of said real estate, for the installation of a 600—car
parking ramp to be constructed thereon, all in accordance
with plans therefor attached hereto; and that otherwise,
said appellants—permittees, and their successors in interest,
shall make due compliance with all applicable ordinances,
state statutes and rules and regulations of public authorities
having cognizance.

Dear Sir:
This is written in response to the appeal of the Kellogg Square Company &
Housing and Redevelopment Authority to relax the density and lot coverage
requirements of the Zoning Code and to their application for a permit to
install a 600-car parking ramp on the block bounded by 4th Street, Kellogg
Boulevard, Minnesota Street, and Robert Street. This property is further
described as Block 25, Saint Paul Prop�er.
The appellants propose to develop the site with a high-rise structure in
conformance with the downtown urban renewal plan and containing 440 apart-
ment units, a parking ramp for 600 cars, and 42,200 square feet of commercial
space.
This matter was considered at the April 17, 1969 Board of Zoning meeting.
The staff reported that the proposed structure covers 75 percent of the ground
area and provides 208.5 square feet of land area per dwelling unit. Although
the code requires a maximum ground coverage of 35 percent and a minimum of
1,000 square feet per unit, it was noted that density and coverage for this
type of facility should be a function of its design. It was also noted that
the proposal calls for a minimum of 100 square feet of open space per unit
including open decks and balconies; and that open space amenities are pro-
vided to some extent by Kellogg Mall across the street. In response to the
parking lot application, it was noted that the proposal meets required design
standards and the approval of the Traffic Engineer.
Consequently, it was the finding of the Board of Zoning that the density and
lot coverage proposed for this facility are reasonable and that the proposed
parking meets requ�red standards. The Board, therefore, unanimously recommends
approval of both the appeal and the permit.

The Authority's redeve.lopment p.lan for the Downtown Urban Renewal Area, Project
Minn. R-20 (City of Saint Pau.l), (adopted Apri.l 29, I964, by its Resolution No. 64-
4/29-3) was approved by the Council of the City of Saint Pau1 on May 15, 1964 by its
Reso.lution, Counci.l Fi.le No. 218124. "B1ock J" or'Parce.l J"of the Downtown Urban
Renewa.l area is bounded by Fourth Street on the north, Kellogg Bou.levard on the
south, Minnesota Street on the west and Robert Street on the east, and is .legally
described as: B1ock Twenty-five (25), City of Saint Pau1 (Saint Pau.l Proper).
This block ha.s been used for various commercia.l purposes, inc.luding pub.lic parking
.lots and office buildings.
The redevelopment of this parcel in accordance with the Downtown Urban Renewal
FLan, as established, is in the vita.l and best interests of the City of Saint Pau.l and
the health, safety, morals and welfare of its residents.
In furtherance of the Downtown Urban Renewa.l P.lan, therefore, the Authority has
agreed to se.l1 and convey and Ke.l.logg 5quare Company has agreed to purchase and
deve.lop the premises by constructing approximate.ly 440 apartment units, a 600-car
parking ramp and 42,200 square feet of commercial space. Of the 440 apartment
units, 18 will be in the form of townhouses, the remainder being situate in the apart-
ment tower.

The purpose of this appea.l is to obtain an exception, variance, waiver or other ap-
proval from the Council of the City of Saint Pau1, to or from Legislative Code,
Chapter 60, Section 60.24, Paragraphs (a) and (b).
The referenced Legis.lative Code paragraphs provide, in effect, that:
a) The tota.l amount of 1ot area covered by the residentia.l bui.lding or
structure sha.11 not be more than thirty-five per cent (35%) of the tota.l
1ot area.
b) For dwelling units larger than a two-family house, the minimum
1ot area expressed in square feet sha.l.l be 6,000 square feet for the
first two units p.lus 900 square feet for each additiona.l unit; however,
in no case shal.l the lot area for each individual unit be less than l,000
square feet.
The proposed redeve.lopment comprises a structure which wi.11 cover more than thirty-
five per cent (35%) of the land area. The number of apartment units which are pro -
posed for the site would require a land area in excess of 450,000 square feet. Block J
contains .less than 90,000 square feet. A waiver of the density and .lot coverage re-
quirements is essentia.l to this redevelopment.

to relax density and lot coverage and an application for a 600-car parking facility
� on property located in the block bounded by Fourth treet, Kellogg Boulevard,
; Minnesota 5treet and Robert Street. Mr. Sorenson aaid thia proposal is part of
� the dos�ato�m urban renewal plan. He said the proposal Would cover more than 75%
t of the ground area: the aite ia approxiaiately 90,000 square feet or approximately
� 208.5 square feet per unit. The Zoning Code calla for a naxinnaa of 357e ground
; coverage aad at least 1,000 aquare feet per unit.
� Mr. Sorenson noted that density on this type of development should be a
E function of its design and that preaeat s�andards do not deal adequately with
high density residential develo�ment fn the Dowataqra.. He noted that the proposal !
calls for at least 1�0 square feet of deck or balcony open,space per unit and
that the I�aII acrosa �Cel#ogg Boulevard adda open space amenities. He said the �
parking facillty aet the desiga standarda and haa the approval of the Traffic
Enginetr. Mr. Daniu voved for spproval, motion seco�d�d by Mr. Gauger and
carrie� unani�wwly.
