THE GOUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining
to Use Districts, Height Districts and Rezoning of certain
properties in the City of Saint Paul, as amended, be and
the same is hereby further amended so as to rezone the
following described property from "A" Residence District to
Gommercial District, to-wit:
The East 156 feet of the Southeast %4
of Section 34, Township 29 North, Range
22 West, except the South 280 feet
thereof, and except all that part there-
of lyin.g North of a line runn.ing west at
right angles to the East line of said
Southeast %4 from a point distant 570
feet South of the center line of State
Trunk Highway #12 measured on said East
line; subject to the rights of the
public in White Bear Avenue;
situate on property located on the west side of White Bear
Avenue immediately south of the new interstate highway I-94
in the City of Saint Paul.
Section 2. This ordinance shall take effect and be in
force thirty (30) days from and after its passage, approval
and publication.

Dear Sir:
This is written in response to the petition of Martin F. Colon to rezone
from "A" Residence to Commercial, property located on the west side of White
Bear Avenue immediately south of the new interstate highway I-94. This
property is further noted on the attached legal description.
This matter was considered at the April 17, 1969 Board of Zoning meeting.
Th,e staff repo`rted that a petition to rezone this same property to Commercial
, — was denied in July, 1968. At this time, it is prop�sed to develop this site
of over 22,000 square feet with a filling station. It was noted that the
s'ite is presently occupied by three single-family homes , in good condition.
Ttie west side of White Bear Avenue, south of the proposed freeway is partially
developed with single-family uses which is in conformance with the Compre-
hensive Plan which calls for a maximum density of 15 d�,rellings per acre. This
area would lend itself to a planned residential development. The area to the
east between the freeway right-of-way is vacant, but zoned Commercial. It was
also noted that the area immediately to the south of this site is proposed
for a fire station location and that the City has had a public hearing sched-
uled on the proposal for May 6, 1969.
Mr. Fred Douglas, representing the Phillips 66 Company, whic h is comtemplating
development of the site, sptske in behalf of the petition noting that the pro-
posed filling station use would not be a traffic hazard and would be screened
from the residential uses by the proposed fire station. He also noted that
the proposed filling station will replace one at Third Street and White Bear
Avenue which in turn may be .used as a building site for St. Pascal's Church.
Mr. Paul Donlin, representing the Church, stated that they wish to purchase
the Third Street and White Bear Avenue site and are in favor of the rezoning.
No one appeared in opposition to the rezoning.

� It was the finding of the Board of Zoning that commercial use of this prop-
erty would be proper if a fire station is to be constructed on the site to
the south. The Board, therefore, recommends by a vote of five to zero,
approval of this petition to rezone from "A" Residence to Commercial, sub-
ject to the decision to acquire the property to the south for a fire station.
