In the Matter of hazardous buildings
being that one and one--half story �r.�e
dwellin.g and garage known and described
as 804 Carroll Avenue in the City of Saint
Paul and situated upon those premises
legally described as Lot 6, Block 2,
Edwin Dean' s Subdivision of part of
Smith an.d Lott Out—Lots, according to
the plat on file and of record in the
office of the Register of Deeds in
and for the County of Ramsey, State of
Minnesota.
WHEREAS, Pursuant to resolution, C. F. No. 243535,
approved April 29, 1969, a public hearing was duly held
on Tuesday, May 13, 196g, before the Council of the City
of Saint Paul, said hearing pertaining to the condition
of the structure located at 804 Garroll Avenue, Saint Paul,
Minnesota; and
WHEREAS, Upon the faets presented at the said hearing
consisting of photographs, inspection reports and the
recommendation of the Gity Architect, it is found and
determined by the City Council that accordin.g to the records
and files in the office of the Register of Deeds, the last
record owner of the above—de�cribed property is Howard C.
Holte; that University Lumber Gompany has a lien against the
property; that Shell Oil Company has an apparent interest;
and that there are no other lien holders of record; and that
Nathaniel Battle has an unrecorded interest; that the taxes
on the property are delinquent and the County Auditor should
be notified of any action; and that it is further determined
that the above—described buildings constitute hazardous
buildings within the de�nition of Minnesota Statutes Section
463.15 for t e followin reasons:

� � a. The buildings are standing open,
� abandoned, vandalized and are subject to
being entered by unauthorized persons;
b. The exterior condition of the
dwelling is as follows : all windows were
apparently smasheci�by vandals, a portion
of the lap siding has been torn off and
portions of the cornice facia board show
evidence of rotting;
c. The interior condition of the
dwelling is as follows: the floors on
the first and second floors are sagging;
in 1967 there was a fire in thebuilding, -
. and many of the charred structural members
still remain; the bathroom floor shows
evidence of rot ; the plumbing and electrical
systems do not appear to be in service, with
evidence of inadequate wiring throughout the
building; and several o� the plumbing fix—
tures have been damaged by vandalism;
d. There is an 18 x 22 foot frame
garage at the rear of the property that is
in a dilapidated condition and considered
structurally unsound;
e. The buildings in the above condition
are beyond reasonable repair;
f. The dwelling is unfit for human
habitation in its present condition and the
above corrections must be made in compliance
with the Building Code an.d the Housing Code
of the City of Saint Paul in order to make
the same habitable;

g. The buildings constitute nuisances
and hazards to the public health, safety
and welfare because of their physical damage,
dilapidation and inadequate maintenance;
now, therefore, be it
RESOLVED, That in accordance with Minnesota Statutes
Sections 463. 15 through 463. 26, and based upon the foregoing
findings of the City Council, the Council of the City of
Saint Paul does hereby make the following Order:
ORDER
l. The owner of the above—described buildingsshall make
the same safe and not detrimental to the public peace, health,
safety and welfare by having the said building,srazed and the
materials therefrom removed from the premises within. thirty
(30) days from the date of the service of this Order.
2. Unless such corrective action is taken to comply
with this Order or an answer served upon. the City of Saint
Paul and filed in the Office of the Clerk of the District
Court of Ramsey County, Min.nesota, within twenty (20) days
from the date of the service of this Order, a Motion for
Summary Enforcement of this Order to raze and remove the said
building will be made to the Ramsey County District Court.
3. In the event that the buildingsare to be razed by
the City of Saint Paul pursuant to judgment of the District
Court, all personal property or fixtures which may unreason—
ably interfere with the razing and removal of these buildings
shall be removed within ten (10) days from the entry of
judgment; and if not so removed, the City of Saint Paul
shall remove and dispose of such personal property and
fixtures as provided by law.

4. If the City of Saint Paul is compelled to take
any corrective action herein, all necessary costs expended
by the Gity will be assessed against the above—described
real estate and collected as other taxes; and be it
FURTHER RESOLVED, That a certified copy of this
resolution and incorporated Order herein be served upon
the last record owner of the above described property in
the manner provided by law and also upon other interested
parties in the manner provided by law.

Gentlemen:
The Building Department is hereby submitting its report on the
condition of the property known as 804 Carroll Avenue, a single family
dwelling of frame construction, 1-1/2 stories high and, approximately 24 ft.
wide, 36 ft, long and 22 ft. high. There is a garage at the rear, also in
hazardous condition.
On May 2, 1969, the City Council authorized, the Public Works crews
to board up the building, since it had been open and vandalized. in an inspection
on April ?, 1969.
The legal description of the property is Lot 6, Block 2, Ed.win Dean's
Subd.ivision of part of Smith and, Lott Out-Lots. The last record owner is
Howard C. Holte.
The most recent inspection indicates the following:
EXTERIOR. A11 windows were apparently smashed. by vand.als. A
portion of the 1ap siding has been torn off and portions of the cornice facia
board. show evidence of rotting.
FIRST FLOOR. Contains two rooms. Evidence that the floors are
sagging, possibly due to the inadequate floor joists and. rotting of the wood
supporting posts in the basement.
SECOND FLOOR. Contains three rooms and bath. The floors show evid.ence
of considerable sag.
In 1967 this build.ing was d,amaged by fire that started in the basement.
Sorne temporary repairs were started at that time, but were never completed.
Many of the charred structural members still remain.

The bathroom floor on the second floor shows evidence of rot.
The plumbing and electrical systems do not appear to be in service, with
evidence of inadequate wiring throughout the building, and several of the
plumbing fixtures have been damaged by vandalism.
GARAGE. There is an 18x22 ft. frame garage at the rear of the
property that is in a dilapidated condition and considered structurally unsound.
Inasmuch as a rehabilitation schedule has not been submitted by the
owner, it is the conclus ion of the Bureau of Public Build.ings that by reas on
of inadequate maintenance, dilapid.ation, physical damage, unsanitary
condition and abandonment, the above structuresconstitute a hazard to public
health, safety and welfare. It is hereby recommended that the Council concur
in this conclusion and. refer the matter to the City Attorney's office for submission
of this condemnation to the District Court.

This is in reply to your notice to Shell Oil CAmpany,
as an interested party of the hazardous condition of the
building located at 804 Carroll Avenue, St. Paul , Minnesota
and eminent razing of the structure if corrective action is
not taken.
Please be advised that we hold a first mortgage on
the described property from Nathaniel and Ruth Battle. As
such, we have no authority to correct the deficiencies noted
or pay delinquent taxes. This, of course, would change in
the event of a foreclosure. At present, no such action has
been instituted.
