WHEREAS, The Gity of Saint Paul acquired Lots 1 through
9, Block 30, Dawsons Third Addition to the City of St. Paul
for park and parkway purposes in 1902, pursuant to Board File
No. 15881, approved June 17, 1g02; and
WHEREAS, The Department of Public Works has been authorized
to widen Marion Street from Como to University and has requested
that a portion of the above land be dsdicated by the Gity for
street purposes; and
WHEREAS, The Commissioner of Parks and Recreation and
Public Buildings approves of said request; now, therefore, be
it
RESOLVED, That the Council of the City of Saint Paul does
hereby dedicate the following lands for street purposes , and
the Gity Clerk is directed to cause a certified copy of this
dedicating resolution to be placed on file with the Register
of Deeds in and for the County of Ramsey:
All of Lots 5, 6 and 7 , and those parts of Lots 3,
4, 8 and 9, Block 30, Dawson' s Third Addition to the
Gity of St. Paul, lying northwesterly of a line
described as follows : Beginning at the intersection
of the east line of Marion Street and the south line
of Thomas Avenue; thence 58. 5 feet northerly along
the east line of Marion Street; thence bearing right
along a circular arc, tangent to the east line of
Marion Street at the last mentioned point, with a
radius of 285 feet, said curve terminating at the ,
southwesterly line of Como Avenue.

Gentlemen:
Reference is made to the letter of Commissioner Tedesco (copy
attached) , dated February 20, 1969 concerning the dedication of Park
and Parkway lands for the i.mprovement of MARION STREET from Aurora
Avenue to Como Avenue. This matter was referred to the Bureau of
Valuations for further study.
Attached is a map of the area indicating the present and antici-
pated future uses of the lands within the limits o£ the triangular
tract bounded by Como Avenue, Thomas Avenue and Galtier Street. On
said map the immediate right-of-way needs of the Department of Public
Works to improve ,Marion Street are shown shaded red (Playground, Park
and/or Parkway land) and orange (School District land) . The remaining
playground and park land is shown shaded brown; the school land in
yellow; lands under jurisdiction of but surplus to the needs of the
Department of Public Works, shaded green; and privately owned lands
anticipated for future playground expansion shaded blue.
As shown on the map, a small portion of the present Scheffer
. Playground site is required for right-of-way purposes. Included in
this area is chain link fencing. Condemnation proceedings have been
� initiated on this small parcel with Final Order C.F. 240046, approved
September 3, 1968 and amended by C.F. 242147, approved February 14,
1969. It is advised that this parcel remain a part of the condemnation
proceedings. �
The tract of land shaded green west of Marion Street was recently
acquired in conjunetion with the Marion Street Opening project. This
land is surplus to the needs of the Department of Public Works. It
• appears that transfer of the jurisdiction of this land to the Parks
Department could be accomplished by Council Resolution. This transfer
would coincide with the Parks Department program for the expansion of
the Scheffer Playground as part of the 1972 CIB program.
The acquisition of the land shaded orange is being negotiated
with the representatives of the School District. I have been advised
that the Scheffer School will be abandoned upon completion o�' the
T69-t70 school year. This facility is to be replaced by an addition
to the Jackson School. In view of this, it is proposed not to disturb
the brick vestibule on the school building at this time. A temporary
bituminous walk around said sc�ool extention will be required for a
one year period. The appropriate instruments to convey the school
lands shall be submitted to the City Council for approval at a future
date.

The tract of land shaded red east of Marion Street is presently
used as play area in conjunetion with the Scheffer School. The
improvement project proposes the construction of the roadway across
this area to connect with the Como and Lafond intersection. The
. existino fencing along the east line of Marion Street will be relocated
as a part of the project along the new street alignment prior to the
start of school in the fall. These lands were originally acquired by
the City for Park and Parkway use. Transfer of jurisdiction could be
accomplished by Council Resolution.
In summary, to effectuate the necessary transfers of lands, I
recommend the following:
_ l. That the Council proceed with the condemnation of the
small parcel of the playground land with damages paid
to the Department of Parks for the depreciated value
of the existing fence or its cost to replace in like
kind.
2. That the property shaded red on the attached plan east
of the present Marion Street be dictated by Council
Resolution for street purposes. Said land is described
as follows:
All of Lots S, 6, and 7, and those parts of
Lots 3, 4, 8, and 9, Block 30, DawsonTs Third
Addition to the City of St. Paul, lying north-
westerly of a line described as follows:
Beginning at the intersection of the east line
of .Marion Street and the south line of Thomas
Avenue; thence 58.5 feet northerly along the
east line of Marion Street; thence bearing
right along a circular arc, tangent to the east
' line of Marion Street at the last mentioned point,
with a radius of 285 feet, said curve terminating
at the southwesterly line of Como Avenue.
3. That the property shaded green on the attached plan west
of Marion Street be dedicated or transferred by Council
Resolution for Parks and Playground purposes. Said land
is described as follows: '
