RESOLUTION—GENERAL FORM

In the Matter of a hazardous
building being that two and one–half
story frame duplex known. and described
as 57� West Central Avenue in the City
of Saint Paul and situated upon those
premises legally described as Lot 3,
Block 11 , Mackubin and Marshall ' s addi–
tion to Saint Paul, according to the
plat on file and of record in the
- ' office of the Register of Deeds in and
for the County of Ramsey, State of
Minnesota.
WHEREAS, Pursuant to resolution� C. F. No. 244371, approved
June 10, 1969, a public hearin.g was duly held on Wedn.esday, June
25, 1969, before the Council of the Ci�y of Saint Paul, said
hearing pertaining to the condition of the structure located
at 5'70 West Central Avenue, Saint Paul, Minnesota; and
WHEREAS, Upon the facts presented at the said hearing
consisting of photographs, inspection reports and the
recommendation of the City Architect, it is foun� and deter– -
mined by the City Council that according to the records and
files in the office of the Register of Deeds, the last record
own.ers of the above–described property are Georgette Johnson
ar�.d Arnesto S. Narango, life estate; Jessie L. Freeman,
Jeanette Fuller and George K. Harris, remaindermen; that
according to the records in the County Auditor' s Office, the
real e�state taxes for the years 1965 to the present are
delinquent; and further there is a lien in favor of the
State of Min.nesota, Inheritance Tax Division; and that it is
further determined that the above–described building con–
stitutes a hazardous building within the definition of
Minnesota Statutes Section 463. 15 for the following reason.s:

a. The building is standing vacant,
abandoned and is subject to being entered
by unauthorized persons;
b. The exterior condition of the
building is as follows: All the windows
and door openings have been vandalized and
the windows are broken; the rear porches
are in danger of collapse; the limestone
foundation is deteriorated due to the mortar
eroding from between the stones; the base-
ment exterior hatchway open.ing has been
broken and the center supporting beam is
sagged due to rotting and overloading; the
basement window wood frames have been
smashed and badly rotted;
c. The interior condition of the
building is as follows: plaster on the
walls and ceibngs on the first floor,
second floor and attic is cracked and
falling and portions have already fallen;
much debris is strewn about in the attic;
the heating for the third floor was via a
� space heater with the rest of the building
being heated by a gas warm air furnace; the
condi'�ti��. of both appliances is question-
able and must be classified as inoperable;
the�:gluhtbing system is not functional as
most of the fixtures have been smashed or
removed; the electrical system has been
vandalized to the point that it is inoper-
able and would require rewiring;
d. The building in the above condition
is beyond reasonable repair;
e. The building is unfit for human
habitation in its present condition and the
above corrections must be made in compli-
ance with the Building Code and the Housin.g
Code of the City of Saint Paul in order to
make the same habitable;

f. The building constitutes a nuisance
and a hazard to the public health, safety
and welfare because of its physical damage,
dilapidation and inadequate maintenance;
now, therefore, be it
RESOLVED, That in accordance with Min.nesota Statutes
Sections 463. 15 through 463. 26, and based upon the foregoing
� findings of the City Council, the Council of the City of
Saint Paul does hereby make the following Order:
ORDER
1. The owners of the above-described building shall make
the same safe and not detrimental to the public peace, health,
safety and welfare by having the said building razed and the
materials therefrom removed from the premises within thirty
(30) days from the date of the service of this Order; .
2. Unless such corrective action is taken to comply with
this Order or an answer served upon the City of Saint Paul and
filed in the Office of the Clerk of the District Court of
Ramsey County, Minnesota, within twenty (20) days from the date
of the service of this Order, a Motion for Summary Enforcement
of this Order to raze and remove the said building will be
made to the Ramsey County District Court�
3. In the event that the building is to be razed by
the City of Saint Paul pursuant to judgment of the District
Court, all personal property or fixtures which may unreason-
ably interfere with the razing and removal of this building
shall be removed within ten (10) days from the entry of
judgment; and if not so removed, the City of Saint Paul
shall remove and dispose of such personal property and
fixtures as provided by law;

4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by
the City will be assessed again.st the above-described real
estate and collected as other taxes; be it
FUR.THER RESOLVED, That a certified copy of this
resolution and incorporated Order herein be served upon
the last record own.er of the above-described property in
the manner provided by law and also upon other interested
parties in the manner provided by law.
