Dear Sir:
This is written in response to the application of Mil-Ore
Enterprizes for a permit to install a 65-car parking lot to be
used in conjunction with two proposed 30-unit apartment buildings
on the south side of Hoyt Avenue between Payne Avenue and
Edgerton Street. This property is further noted on the attached
legal description.
This matter was considered at the December 19, 1968, Board
of Zoning meeting. The staff reported that the rezoning of this
property to "C" Residence was pending and that final plans for
the proposed parking lot had not yet been submitted. Informal
approval of the parking lot was granted by Council on
November 22, 1968.
Mr. Roy Spannus, representative of the applicant, explained
that he had confered with the staff and would bring in plans
which would meet all of the required standards in every respect.
Subsequently, the Board of Zoning voted 4-0 to recommend
approval of this application subject to plans being submitted
which would meet all the recommendations of the staff.
When subsequent plans were received, it was discovered that
the apartment buildings were being constructed in violation of
the setback requirements of the Zoning Code. The applicant,
therefore, appealed this setback requirement and was granted a
variance on May 20, 1969. With this variance, plans received
February 11, 1969, meet all design standards and, therefore, the
application now has a recommendation of approval from the Board
of Zoning.

A. HISTOR�: The area to the east of the north portion of this site was zoned Coamiercial
with a negative easement restricting use to parking only, Nov., 1960. A petition to
rezone the north portion of this site to Commercial was withdrawn May, 1968. This
site was rezoned to "C" Residence and the adjoining area to the east was rezoned to
Com�nercial by the Council Jan. , 1969. An appeal was also granted for this site
relaxing the Hoyt Avenue setback from 26 to 20 feet on May 20, 1969.
. B. AREA ZONING: To the north across Hoyt Ave. , "C" Residence; to the east for two blocks
along Payne Ave. , Cominercial; and the remainder of the surrounding area, "A" Residence
C. DESIGN STANDARDS: Revised plans now meet all design standards. Off-street parking
is provided at the rate of 1.08 spaces per unit.
D. FRONTAGE & AREA: The site has a frontage of 160 feet on Hoyt Avenue and consists
of 67,270 square feet or 1.54 acres.
E. TRAFFIC ENGINEER: The Traffic Engineer recammends approvsl.
F. SITE CONDITIONS: The site is being filled and construction is underway with informal
approval of this application being granted by the Council, 11/22/68, sub�ect to the
applicant's risk and outcome of hearings on this matter.
G. AREA CONDITIONS: Area to the south is developed with single-family residences; to
the east with caaimercial uses; to the north with two, 18-unit apartment buildings;
and to the west with single-family residence and vacant land.
