WHEREAS, LEGACY MANAGEMENT AND DEVELOPMENT CORPORATION (Rondo Outreach library), 04-135-
263 has submitted for City Council approval the attached preliminary and fmal plat for subdivision of property at the SW
corner at Dale, legally described as Lots 1, 2, 3, 4, 23, 24, 25, 2b, 27, 28, 29 and 30, Chute Brother's Division No. 1.
Addirion to the City of St. Paul, Minn. and public alley as dedicated in the Chute Brother's Division No. 1 Addition to the
City of St. Paul, Minn., according to the recorded plat thereof, Ramsey County, Minnesota, vacated, which lies east of the
northerly e�rtension of a line 3.00 feet east of and pazallel with the west line of Lot 24, said Chute Brother's Division No. i
Addirion to the City of St. Paul, Minn., and which lies west of a line drawn from the southeast corner of Lot 1 to the
northeast corner of lot 30, all in said Chute Brother's Aivision No. I., to create 5 vertically and horizontally described lots
For a miged-use residential aud institutional development, and dedication of a public alley; and
WHEREAS, the appropriate City departments have reviewed the plat and found, sub}ect to the recommended conditions, that
it meets the zequiremerns of Chapter 67 of the Zoning Code; and
WHEREAS, notice of a public hearing before the CiN Council was duly published in the official newspaper of the City and
notices were mailed to each owner of affected property inc(uding a11 property situated within 350 feet of Che subject property;
and
WHEREAS, the City Councii held a public hearing on the proposed plat on November 3, 2004 where all interested parties
were given the oppomuuty to be heard and the Council considered all the facts and recommendations concerning the plat;
NOW, THEREFORE, SE IT RESOLVED, that the Ciry Council accepts and approves the attached preliminazy and finai plat
far Rondo Branch library at the b26 University Ave. subject to the condition that the applicant shall file a copy of the Council
resohrtion approving the plat with the Rasnsey Counry Recorder's Office.

reviewed the proposed p(at and have determined ffiat aIf applicabie provisions of city

2. The proposed subdivision will not be detrimenta! to the present and potential surrounding
land Uses. The proposed p(at is consistent with the surrounding land uses, and will not be
detrimenta! to present and future use of sui land. The site is currentty vacant,
and had been used as an outdoor market since the Faust Theatre was demolished in The
eariy 1990s. Construction of a"landmark" buitding with a significant civic use at fhis key
intersection along University Avenue wiil be beneficial to the surrounding land uses.
3. The area surrounding the subdivision can be planned and developed in coordination and
compatibility with the proposed subdivision. The area surrounding the proposed plaf is
already deveioped and compatible with the proposed plat.
4. The sutidivision is in conformance with the comprehensive plan. The subdivision is in
cortformance with the iand use chapter of the comprehensive plan, which calfs for botF�
residential and commercia! uses of the node. The subdivision provides for the kind of
mixed-use development calfed for here in the Comprehensive Plan and the University-Dale
TransiY-Oriented Development 5tudy.

5. The subdivision preserves and incorporates the site's impo�tant existing natura! features
whenever possible. Tne site is in a ful(y-deve(oped part of Saint Paui wfth no remaining
naturalfeatures. •
6. All /and intended for building sites can be used safely without endangering residents by
peri/ from floods, erosion, continuously high water table, severe soil condifions or other
menace. The site is generaily flat. There is no threats of floods, erosion, high water table,
or severe soii condifions on fhe sife.
7. The subdivision can be econornically served wifh public facilities and services. The
subdivision can be economically served with public facilities and services from surrounding
streets.
(. STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends
