Marshall, City Clerk Room 386, City Hall & Courthouse Saint Paul, Minnesota 55101 Dear Sir: This is written in response to the appeal of Eugene P. Giblin and Richard J. Coverdale to relax the density requirements of the Zoning Code as they apply to property located on the south side of Grand A.venue between Finn Street and Cleveland Avenue. This property is further described as Lots 21, 22, 23, and 24, Block 2, Groveland Addition. This matter was considered at the May 15, 1969 Board of Zoning meeting. The staff summarized their investigation noting that most of the property covered by this appeal was the subject of an earlier appeal to relax the density re- quirements which was withdrawn prior to Zoning Board consideretion. The pro- posed use of the property at this time is a 23 unit apartment building. In a Commercial district 23 units require a land area of 24,900 square feet. This site, however, contains only 24,000 square feet, 900 square feet or 3.75 per- cent short of the requirement. Staff conclusions noted that although the Commercial zoning allows multiple-family use the Comprehensive Plan recommends that the density be limited to a maximum of 25 dwellings per acre or 13 units for this size site. It was noted that the established density standards are reasonable and that the requested variance is excessive amounting to the area for one complete unit. It was also noted that no practical difficulty or peculiar hardship exists that would prevent the property being developed in accordance with the Zoning Code. Mr. Giblin and Mr. Coverdale spoke in behalf of their appeal noting that they are proposing 28 parking spaces on the site and that because the land is ex- pensive they wish to develop the property to the fullest extent possible. They also noted that because the land is zoned Commercial it could be devel- oped with 22 residential units and one comtaercial unit but they preferred to have all residential units. Mr. 0'Keefe, a neighborhood resident, appeared and questioned the adequacy of off-street parking noting the proximity of Mitchell Law School, St. Thomas College and other apartments to the west on Grand Avenue. Marshall -2- June 9, 1969 Subsequently, it was the finding of the Board of Zoning that it would be possible to have one commercial use in addition to the permitted 22 residen- tial units; that the appellants preferred to have all residential units; that the variance is only 3.75 percent and that sufficient parking is to be provided. The Board, therefore, recommends by a 4�0 vote, approval of this appeal to relax the density standards. Even though adequate off-street parking is provided for the new building, the mere provision will not insure that the residents of the proposed building will use the space. Coverdele for Lots 21, 22, 23 and 24, 81ock Z, Groveland Addition is raised at this time by rea�ons of present conditions occurring at the 40 feet ad,jacent to the above mentioned lots on the south side of Grand Avenue at Finn Street, and an inaclequate alleyway. There are two separate dwellings occupying the same one lot. The dwelling at 2118 Grand Avenue contains either two or three apartments on three floors, of which no proper fire escapss are visible for the upper floors. At the rear of 2118 Grand Avenue is 64 South Finn Street, a one and one-half story dwelling two fe�t frora the alley. Over the years this house has deteriorated by lack of care and maintenance. Often times trash has been allowed to � pile into larg� masses. Rubbish is burned next to the side of the house. 8ased upon the assumption that the two above r�entioned dwe�ling� are probably not meeting current health, safety, and housing codes, as well as being an unsightly, attractive nuisance, and that I�r. Giblin and �ir. Coverdale intend to build a 23 unit apartment building with parking facilities for 28 cars, it is believed that it would be best that they furnish separate on-street entrances to these parking facilities - not connected to the alley. The present alleyway is of "T" formation with two "blind" corners. Needless to say, this does pose some danger to young children, as well as to adult5.
