RESOLVED, Upon the pertinent appeal, under the Zoning
Code, by Gordon. R. Struck, owner of the subject premises,
zoned in "C" Residence District, under said Zoning, Code,
described as Lots 1 and 2, Block 2, Skidmore & Cassedy' s
Park Addition To The City of Saint Paul, Ramsey Co. , Minn. ,
according to the plat thereof on file and of record in the
offiee of the Register of Deeds in and for Ramsey County,
Minnesota, that the provisions of said Zoning Code, in
respeet to density requiremen.ts, hereby are determined and
varied, in their application to said real estate, as and to
the extent necessary therefor, and that a permit hereby is
granted unto said appellant, and his successors in interest,
in respect of said real estate, for construetion of a ten—
unit apartment building to be constructed thereon, all in
accordance with plans therefor dated Reeeived May 8, 1g69;
subject to the following conditions: that 8 garages be con—
structed on the southerly line of the property and that the
space on the westerly side of the property, originally
designated for 4 garages, be left as open parking space; and
that the setback area on the westerly side of the property
be a grass area as shown on the plan; and that otherwise, said
appellant—permittee, and his successors in interest, shall make
due compliance with all applicable ordinances, state statutes
and rules and regulations of public authorities having

Dear Sir:
This is written in response to the appeal of Gordon R. Struck to relax the
density requirements of the Zoning Code as they apply to property located on the
southwest corner of Marshall Avenue and Wheeler Street. This property is further
described as:
Lots 1 and 2, Block 2, Skidmore and Cassedy's Park Addition
This matter was considered at the July 3, 1969, Board of Zoning meeting.
The staff reported that the proposed apartment use is proper under the "C"
Residence zoning of the site, but that the area of 12,880 square feet permits
nine units while the appellant desires ten. Ten units under existing standards
require 13,200 square feet, indicating a variance of about 22%. Staff conclusions
noted that the proposed use could help revitalize the area, although there is no
evidence or clairn� of hardship peculiar to this site that would justify the
variance.
Mr. Struck, the appellant, stated that the permitted nine units would be
in conflict with his proposed floor plan.
Several neighbors spoke in opposition to the appeal stating that the
appellant has not maintained other new apartments he has constructed nor the
present uses on this site, and that the proposal may create a traffic hazard.
After further discussion, it was the finding of the Board of Zoning that
the appellant was within the law in asking for the appeal and that the variance
was small. The Board, therefore, recommends approval of this appeal to relax
the density requirements by a vote of 3-2.

l�iessre. Sorenson and Wilkerson and Mrs. Iriah and Z1iss Poechmann
of the staff. Mr. McPartlin was also presenC but did not vote.
60RDON R. STRUQC: An appeal to relax density requirements ta permit the
erection of s 10-uuiC apartment builc�iag with 12 garages. Mr. Sorenson
outlined the staff report atating the site is short of the area require-
ments by a 2.42 percentage -- unit basis SS0.5 sq. ft. ahort, 68.9�.
The frontage along Marahall Avenue is zoued "C" xesidence and the area to
the south is $oned "B" Residence. The site is presently occupied by two
single-family frame reaidences in need of some rehabilitation. The volume
of tra€fic on Marshall Avenue is high. The multi-family usea in this area
are predominsatly contained ia old structures that have been converted.
l�r. Sorensan gave the following points in favor of the appeal: 1) the
zoniag fa proper for this use; and 2) new conatruction could help revitalize
Che area. He gave these points against the appeal: i) the density etandards
are reasonable; 2) the variance baeed on one additional unit is exceesive
(total variance 2.42'�); and 3) no evidence or claim of hardship peculiar to
the site.
Dr. Strnck, the appellant, said he would make an effort to make the new
apartments nicer-than-average. Ae also said he wouldn't want to have it
cut dowa to a 9-uait structure because that would conflict with the basic
floor plan.
Mr. William Hunt, a neighbor speaking for the neighbors in opposition, stated
that Dr. Struck's many properties are deteriorating snd not kepC up at all.
Mr. Bdward Cusick, 1768 Marshall, co�►ented that subject property atood empty
for three yeare. Mrs. Eve�yn DeRoaier said the apartmen� building would
create a traffic hazard. Dr. Struck agreed that the outside of the preaeat
buildings on the aite are in need of repair; he said there is so �ch work
neceasary, it i�e difficult to know whexe to begin � it would not pay to
invest money in the old buildinge. Nr. John Moody said there are two
apart�ent buildings in the �m�uediate ares which are sufficiene; he felt
that geople living in apartments tend to be transients.
Dr. Struck said the neighbors` opposition is beaed on feeliags. not facta.
Mr. Gadler stated that he was oppoaed to the appeaZ because of ths ob�ections
fx'om the neighbors. Mr. Cohen moved for approval becauae the varisnce was
slight and Dr. Struck was within the law in askiag for the appul;
Mr. MafetCa seconded the motion. It wae a eplit vote of 3-2 in favor, with
