The surveyor change the elevation notes on Sheet 2 that refer to NGVD 29 DATUM to NGVD 1929 DATUM; 2. Outlot A be tied to one of the abutting parcels for t� purposes; o�- ��i Preliminary and Final Plat Approval for the Lander Group at XXX 10�' St. East � The tunnel access/maintenance agreement between the property owner and the City shall be recorded along with the plat; Encroachment permits be obtained for the encroachments being allowed in Temperance Street other than the tunnel; 5. A public sidewalk easement along the north side of Ninth Street be recorded with the plat to assure that minimum unobstructed public walkways aze maintained 6. DISTRICT COUNCIL RECOMMENDATION: Recommended approval. H. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that ail of the foliowing findings shall be made prior to approvai of a subdivision: 1. All the applicable provisions of the Legislative Code are complied with. City staff have reviewed the proposed plat and have determined that all applicable provisions of city codes are met. 2. The proposed subdivision will not be detrimental to the present and potential surrounding land uses. The proposed plat is consistent with the surrounding land uses, and wiil not be detrimental to present and future use of surrounding land. The surrounding uses are of like intensity and use in this downtown district. 3. The area surrounding the subdivision can 6e planned and developed in coordination and compatibility wfth the proposed subdivision. The area surrounding the proposed plat is partially developed and compatible with the proposed plat. • 4. The subdivision is in conformance with the comprehensive plan. The subdivision is in � conformance with the housing chapter of the comprehensive plan, which calls for production of housing units "...that can be sold or rented to smaller househoids..:' It also conforms with redevelopment plan for the North Quadrant. 5. The subdivision preserves and incorporates the site's important existing natural features whenever possib/e. The site is in a fully-developed part of St. Paul with no remaining naturalfeatures. 6. All land intended for building sites can be used safely without endangering residents by peril from floods, erosion, continuously high water table, severe soil conditions or ofher menace. The site is a flat, fully developed area with no flooding, erosion, high water table or soil condition problems. 7. The subdivision can be economically served with public facifities and services. STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends approval of the final plat for XXX 10th Street East in the area bounded by 9th, Sibley, 10th and Jackson Streets subject to the foilowing conditions: 1. The subject property is part of the block bounded by Ninth Street, Tenth Street, Sibley Street and Jackson Street. The block currently contains surface parking lots and the Renaissance Box building, which is not included in the project. The project includes new construction of three apartment/condominium buildings and extension of Temperance Street from Ninth Street to Tenth Street. The three buildings will alf have underground �arking garages that are served by one common access on Ninth Street. The redeveloped property will be replatted into three lou, with easements for the public road and the private tunnel under the street. 7he following is an excerpt from the February 20, 2004 letter to Paul St. Martin regarding the Temperance Street easements. After various discussions between City staff, and representatives of Loucks and the Developers, the cur�ent proposal is that an fasement Agreement between the Project ownership entity, Printers Row LLC, and the City will be prepared by counsel, to the City and the Developers addressing the following: �� 1. The Easement Agreement will provide an easement for street purposes for Temperance Street in favor of the Gty, including an easement for underground utiliry facilities to a depth mutually agreeable to the Developers and the City that allows for the installation of necessary utilrties, while also allowing the Developer's proposed tunnel. 2. The Easement Agreement will provide that the City is responsible for the operation, maintenance and repair of the improvements constructed or installed in the street and utility easement areas. The Developers will be responsible for the initial construction of the street, but wi1� have no responsibility for any const�uction o� installation of any underground utilities. 3. The Easement Agreement will provide that the Project ownership entrty (and ultimately the condomrnium unit owner's association) will be responsible for the construdron, operation, maintenance and repair of the tunnel. 4. The Easement Agreement will also contain provisions allowing either party to access the other party's property or easement area for purposes of conducting construction, installation, maintenance and repair activities under certain mutually agreeable terms and conditions. 5.
