As you know, a similiar order xas approved on Maroh 11,
1969. At the publ3c hearing scheduled Sor April 29, 1969 s
great deal of opposition. was rais�d and this pro�eQt xaa ab
doned. I aon�ider it an unwarranted harassment that you se�
fit to pla�e this matter again on the calendar atter three
short months.
Would you please advise me just Mhat caused this •matter
to be brought up onee more.

Protest on behalf of Saint Paul Academy
and Summit School
Gentlemen:
We understand the above order proposes :
1. Immediate reconstruction of defective portions of the exist-
ing sidewalks on the east side of Davern Street from Highland Parkway
to Randolph A.venue and on the west side of Davern from Highland Park-
way to Hartford, and
2. Construction of a brand new sidewalk (none presently existing)
on the West side of Davern Street the approximate 1/� mile distance
from Hartford to Randolph, which latter property borders on the Saint
Paul Academy and Summit School grounds.
Saint Paul Acade�r and Summit School (SPASS) respectfully requests
that any order entered either'
A. Exclude the construction of a sidewalk along the west side
of Davern from Hartford Avenue to Randolph; or
B. Defer for at least one year any order in respect to placin�
a sidewalk on the west side of Davern from Hartford to Randolph.
The reasons for requesting this action include the following:

l. SPASS, as a result of the consolidation of Summit School
into Saint Paul Academy in 1g68, is now engaged in remodeling its
existing buildings on Randolph Avenue and in making plans for very
extensive additions to its buildings on the Randolph Avenue grounds
presently scheduled for construction in 1970-71. Plans contemplate
reloeation of driveways and building entrances, including drives
and building entrances from Davern Street. Such construction would
undoubtedly result in substantial damages to any new sidewalk along
the west side of Randolph on the school grounds and require rebuild-
ing of portions of it within the next twenty-four months .
2. There is no "traffic need" for a sidewalk on the west side
of Davern unless perhaps in the section of approximately three to
four hundred feet running from Randolph Avenue South to a new en-
trance if located on Davern. There are and will be no structures or
even entrances to the school grounds on the west side of D�vern be-
yond the present or new entrances which are or will be on D�,vern a
short distance south of Randolph.
3. Construction of a new sidewalk on the west side of Davern
for at least most of the distance from Randolph south to Hartford
would constitute an expenditure of funds with no resulting public
benefit. The existing sidewalk on the east side of Davern is ample
for any present or prospective pedestrian traffic, at least south of
the school entrance on Davern.
�. The total cost of the sidewalk on the west side of Davern
along the school �rounds of SPASS would be close to $5,000 . SPASS
incurs every year a substantial operatin� deficit made up from con-
tributions. The school has at the present time a substantial scholar-
ship progra.m. Any unnecessary exp�nse reduces by just that much what
can be spent on education. The cost of this sidewalk would be equivalent
to several full tuition scholarships.
5. There are ample precedents in St. Paul for "sidewalking"only
one side of a street, especially where as here, it is not a question
of initially sidewalking a street but of simply repairin� a sidewalk
already laid out along one side. While no study of this matter has .
been made, we call specific attention to the following:
a. The reconstruction, in the summer of 1969, of the
sidewalk along the south side of Hartford Avenue between
Davern and Fairview without the construetion of any sidewalk
alon� the north side of Hartford between the same two points
where it borders on the grounds of Saint Paul Acaderr�y and
Summit School.
b. The reconstruction, in �968, of the sidewalk on the
north side of St. Clair Avenue between Avon and Victoria
without the construction of any sidewalk on the south side
of St. Clair Avenue between the same two points in Linwood
Park.

c . The laying out of a sidewalk some years ago along
the east side of Fairview Avenue between Hartford and
Randolph without the construction of any sidewalk along
the west side of Fairview between the same streets abut-
ting on the grounds of St. Catherine 's College.
In conclusion, SPASS has al�n*ays undertaken to be a ��good
citizen". Not only has it paid substantial assessments of various
kinds in the past, but it furnishes a major recreational facility
to the public through the opening of its grounds to the public for
tennis, baseball and general recreation on weekends and after school
hours. It is also making available to public as well as independent
schools its recently completed indoor ice skating facility.
It is respectfully requested that Saint Paul Acaderr�p and Swnmit
School be relieved of what would be essentially an unnecessary ex-
pense and that any order respecting the above p roposed sidewalk be
so drawn as to except from its operation the construction of any
sidewalk on the west side of Davern Street between Hartford and
Randolph.
