The applicant shall file a Master Home Owners Association Declaration/Agreement to address the 18 maintenance responsibilities for the private road, pond and aAey in Outlots A, B, and C respectively, 19 and also for the rain gardens, along with the final plat. The applicant shall submit a copy of these 20 Home Owners Association documents to the Department ofi Public Works for review and approval prior 21 to recording with Ramsey County. 22 2. ZONING CODE CITATION: §69.301 states that platting is required when a subdivision (1) creates five or more lots or parcels each of which is 2'/2 acres or less in size, or (2) requires paved streets, alleys and other pubiic improvements, or (3) is previously unpiatted land. §69.304 lists conditions for lot spiits and adjustments of common boundaries. §69.406 provides criteria for review of subdivision applications. These criteria are covered below under "Required Findings." F. HISTORY/DISCUSSION: Twin Cities Habitat for Humanity has purchased this property from the Public Housing Agency (Zoning File # 03-411-924 was the lot split for the parcel). The applicant has also purchased property on the west side of Ames Avenue, which required a rezoning to RM1 (Zoning File # 04-04-115-278}. The project has a conditional use permit for a cluster development (Zoning File # 04-115-339) and site plan review (Zoning File # 03-360731). G. DISTRICT COUNCIL RECOMMENDATION: The District 2 Council supports the project. H. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that all of the foilowing findings shall be made prior to approval of a subdivision: 1. A// the applicabie provisions of the Legislative Code are complied with. City staff have reviewed the proposed plat and have determined that all applicable provisions of city codes are met. 2. The proposed subdivision will not be detrimental to the present and potential surrounding land uses. The proposed plat is consistent with the surrounding land uses, and will not be detrimental to present and future use of suttounding land. 3. The area surrounding fhe subdivision can be planned and developed in coordination and � compatibility with the proposed subdivision. The area surrounding the proposed plat is already developed and compatible with the proposed plat. 4. The subdivision is in conformance with the comprehensive plan. Policy 6.6 supports a variety of initiatives that allow lower income households to move into home ownership. The subdivision also conforms with redevelopment plans for the area. 5. The subdivision preserves and incorporates the site's important existing natural features whenever possible. The site is in a fully-developed part of St. Paui with few remaining natural features. One of the outlots preserves a steep slope that would be di�cult to develop. 6. All land intended for building sites can be used safely without endangering residents by peril from floods, erosion, continuously high wafer fable, severe soil conditions or ofher menace. The site is a relatively flat area with no floodi�g, erosion, high water table or soil condition problems. 7. The subdivision can be economically served with public facilities and services. The subdivision can be economically served with the extension of pubiic facilities and services from surrounding streets. I. STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends approval of the finai plat for Germain Landing sub}ect to the following conditions: 1.
