THE COUNGIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining
to Use Districts, Height Districts and rezoning of certain
properties in the City of Saint Paul, as amended, be and
the same is hereby further amen.ded so as to rezone the
following described property from "C" Residence District
to Commercial property, to—wit:
Lot l, Block 1, Subdivision of and
Addition to Irvine' s Addition of Out
Lots to Saint Paul, exeept the West
48 feet;
situate on property located at the southwest corner of
Minnehaha Avenue and Burr Street in the City of Saint Paul,
subject to the condition that applicant will com�,ly with
the rules and regulations of the Air Pollution Control
Agency and further subject to the conditi�n that applicant
agrees to erect a fence which shall complement the area
between the store and the property located at 476 Min.nehaha
Avenue.
Section 2. This ordinance shall take effect and be in
force thirty (30) days from and after its passage, approval
and publicatitn.

Dear Mr. Marshall:
This is written in response to the p�tition of Philip J. Kormann to rezone
from "C" Residence to Commercial property located at the southwest corner
of Minnehaha Avenue and Burr Street. This property is further described as
Lot 1, Block 1, Subdivision of and Additionto Irvine's Addition of Outlots
except the West 48 feet.
The Board of Zoning considered this matter at its August 21, 1969 meeting.
The staff reported that appeals to extend the non-conforming food market
use on this site were granted in 1946 and 1948. The petitioner now wishes
to enlarge the food market which requires Commercial zoning of the site
totaling 4,704 square feet. Staff conclusions noted that the store is
small and appears to need additional space. Previous appeals have been
granted to allow continued operation of thisstore which has been under the
same ownership for quite some time. The staff also noted, however, that the
proposal represents spot zoning and that the property fronts only on local
streets.
Mr. Philip Kormann, the petitioner, explained that he needed additional space
to expand his store to pr,ovide for new food items and that most of the neigh-
bors have no objection to the rezoning.
Several neighbors appeared and expressed concern about how the property was
to be developed.
After some discussion, it was the finding of the Bo�ard of Zoning that this
rezoning should be granted to allow the continued operation and expansion
of the food market. The Board therefore recommends approval, by a 5 - 0
vote, subject to the following conditiAns:
1) Mr. Kormann will contact Mr. Roberts about the air pollution problem.
2) a fence will be erected to complement the area between the store and
the property of Mrs. William DeMoully, 476 Minnehaha Avenue.

Mr. Ryan aum�arized the st�ff report stating that 15 of � possible i8 (83�)

The prnperty has a froatage of 84 feet alon� Minraehah� Avenue and 56 feet along
Burr Street, resul�ing in an area of 4,704 square feete Surrounding the site

non-existant.

Mro Philip Kor�ann, the petitioner, explained th�r his family has been operating
a stor� there since 1884. He claim�d it is the o1d�sE food m$rket in towne At
the presen� time it is one story, and he p2ans to keep it ichat wsye There is a
refuse burner on the south wall. of the building; it is concrete with s stainlees
sCeel chi�ey, He plans to expand the food markee from about 1700 aquere feet
to 4400 square feet. Parking is on residentfal str�ets and in the Sto Ambrose
Church parkiag lot. He stated that most of �he npighbors have no ob�ection to
the rezonin�. He further explained thet many items in the €ood merket today
didn't even exist some ye�ra ago, ioeo frazen foods, packaged mixes, etc., end
this was why he needed more space.
Mr. G�dler cac�nented that air pollutfon there shQUld be taken care of, and
suggested that Mre Kormann contact Mra Robetts in the Public Utilities Depsrtment.
He noted that bacicyard burnera are probably to be compl�tely eliminated within
3 years anyway.
Mrs. William DeMoully, 476 East Miiinehaha �ivernu�, �.fvea d�recCly behind the food

unloading for the store is done on �finneha�a with trucks parking in the line of
