Kormann to rezone from "C" Residence to Commercial property located at the southwest corner of Minnehaha Avenue and Burr Street. This property is further described as Lot 1, Block 1, Subdivision of and Additionto Irvine's Addition of Outlots except the West 48 feet. The Board of Zoning considered this matter at its August 21, 1969 meeting. The staff reported that appeals to extend the non-conforming food market use on this site were granted in 1946 and 1948. The petitioner now wishes to enlarge the food market which requires Commercial zoning of the site totaling 4,704 square feet. Staff conclusions noted that the store is small and appears to need additional space. Previous appeals have been granted to allow continued operation of thisstore which has been under the same ownership for quite some time. The staff also noted, however, that the proposal represents spot zoning and that the property fronts only on local streets. Mr. Philip Kormann, the petitioner, explained that he needed additional space to expand his store to pr,ovide for new food items and that most of the neigh- bors have no objection to the rezoning. Several neighbors appeared and expressed concern about how the property was to be developed. After some discussion, it was the finding of the Bo�ard of Zoning that this rezoning should be granted to allow the continued operation and expansion of the food market. The Board therefore recommends approval, by a 5 - 0 vote, subject to the following conditiAns: 1) Mr. Kormann will contact Mr. Roberts about the air pollution problem. 2) a fence will be erected to complement the area between the store and the property of Mrs. William DeMoully, 476 Minnehaha Avenue.
