Peterson COMMISSIONE DATF WHEREAS, The Greater St. Paul United Fund and Council , Inc. , 400 Wilder Building, St. Paul , Minnesota, has requested that a permit be granted authorizing the temporary placement and maintenance of symbolic progress thermometers constructed from common building materials and sized approximatety four feet wide by sixteen feet high on dedicated City of St. Paul , Minnesota street and p�rk right-of-way with . requested installation to commence on or about September 28, ig69, and removal to be - completed on or about October 28, 1969, at the north end of the island on Cedar Street at the intersection of Cedar Street and Central Avenue, and on park property on Summit Avenue east of the intersection of Surr�nit and Snelling Avenues. RESOLVED, That the Commissioners of Parks, Recreation and Public Buildings, and Public Works are hereby authorized to issue a permit to the Greater St. Paul United Fund and Council Inc., for the said proposed use of said dedicated right-of-way upon and subject to the following provisions, terms and conditions: 1 , The permittee shall pay the cost of publication of this resolution. �� J 2. The permittee shall pay alt expenses incurred by the Department of Parks, Recreation and Public Buildings, and the Department of Public Works, incurred by this undertaking, said expenses shall be accounted for under Department of Public Works Project Number E-10�+4, 3. That said permittee expressly agrees and undertakes to fully indemnify � and hol� harmless the City of Saint Paul , its agents, officers and employees, from any and all damages, claims, losses, judgments, suits or expenses arising out of or occasioned by the use of said right-of-way contemplated by this permission and authority. 4. That said permittee shall furnish a bond of $10,000.0�" to the City of Saint Paul , conditioned to comply with all the terms of this resolution and to indemnify and ,save the City harmless from any and all loss, liability, judgments, suits, costs, charges, damages or expenses that may accrue to person or property occasianed by the use of said street. That said permittee shall not proceed to use said right-of-wa� or be issued a permit unless and until said permittee shall procure and furnish to said City public liability insurance covering itself and including the City of Saint Paul as co-insured against any liability on account of injury to person or property arising oufi of or resulting from the use of said right-of-way in an amount of $100,000.00 for each individual who may suffer personal injury and $300,000.00 on account of personal injury resutting from any one accident and affecting more than one person, and in,the amount of $100,000.00 because of injury or damage to property on account of any one accident, such insurance coverage to be evidenced by policies of insurance approved by the Corporation Counsel . 6. The permittee shalt notify the Superintendent of Parks and the Department of Public Works Traffic Engineer in advance, in the matter of exact starting and completion dates of installation and removing of said symbolic thermometers and framing. 7. That said permittee shatl file its written acceptance of fihis resolution and of all the provisions, terms and conditions of the same with the City Clerk and shall submit to the Corporation Counsel for his appraval , the aforesaid bond and insurance coverages which shall thereafter be filed with the Comptroller of the City of Saint Paul , not later than September 26, tg69, and in the event of its failure to do so, the permission and authority hereby granted shall lapse.
