Marshall City Clerk Room 386 City Hall Saint Paul, Minnesota 55102 Dear Mr. Marshall: This is written in response to the appeal of John L. and Catherine Wewers to relax the density requirements of the Zoning Code to permit a duplex or. property loaated at the northwest c.orner of Milton and Hatch Streets. This property is further described as Lots 16 and 17, Block 49, Thompson's Addi- tion. This matter was considered at the August 21, 1969 Board of Zoning meeting. The staff reported that the Zoning Code requires a lot area of 6000 square feet in a "B" Residence district. This lot, however, has 5,781 square feet, 219 square feet or 3.65 geraest short of the requirement. It was further noted that this property, a corner lot vacant except for a two-car garage, is in an area of one and two family residences. After disc.ussion with a Mr. Donald Lais, representative of the appellants, it was the finding of the Board of Zoning that this appeal to relax the density requirements is reasonable. Mro Ryan suamnarized the ataff report stating that the aite has inaufficient area for a duplex in a "B" Residence District eince it is required to hsve s 50-foot frontage and 6000 squsre feet. and the property has 5781 aquare feet, which is 219 square feet or 3.65'k short. The aite is level and appraximstely at street grade. It ia occupied with a two--car garage that remains after a house was removed. The area is developed with single and two-family residences. A duplex exists on the property ad�oining to the weaC. Mr. Ryan concluded that under Section 64.03, 0, paragraph i of the Zoning Code, homes for nse by two families on corner lota with deficiency of lesa than 10'X. of the area requirement wt►ere it appears thet the public health, safety, and general welfare will be properly secured ia permitted. Mr. Gadler questioned as to what type of garage was oa the site, and was told a new 2-car stucco garage was erected there. Mr. Doneld I.ais. representing the Wewers, submitted a picture of the proposed building. Nobody appeared ia oppositioa to the appeal. Mr. McPaxtlia moved for approval, which was seconded by Mra Mausur and carried unanimouely. Mre Gadler said he voted for the appeal since the proposed duplex is a good-looking etructure.
