Upon reviewing the correspondence addressed to the Honorable Thomas R. Byrne by Charles S. McGinnis, Colonel, Corps of Engineers, dated December 10, 1969, The La.nd Committee of the City of Saint Pa.ul recommends that the Council make the assurances requested therein for the development of its small boat haxbor. As stated in that correspondence, such should be in the following form: "This �rill certif� assurance of the capability and willingness of the City of St. Paul to provide the requirements of loca.l cooperation outlined in your letter of inquiry dated 10 December 1969 regarding the Harriet Island Harbor project. These require- ments will be provided at the time requested by the District Engineer, U.S. Army Corps of Engineers, in accordance with applicable le�islative authority governin� the project. This is in reference to discussions between Mr. William Donovan, � Valuation Bureau, and Mr. Roger Fast of this office on 5 and 8 December + � 1969 concerning the assurances of local cooperation for the Harriet � Island Small-boat Harbor, St. Paul, Minnesota, project. x K � By letter dated 6 March 1969, this office requested a statement of � assurances from the city of St. Paul that the local cooperation re- quirements for the Harriet Island Harbor project would be met. The j request for assurances was prompted by recent action of the Federal � � Water Resources Council which will require the use of a higher interest � rate for project evaluations than had been used previously. No re- sponse to the 6 March 1969 request has been furnished. The following paragraphs, taken from the 6 March 1969 letter, will provide the in- formation required for action by the city of St. Paul. It should be noted that in order to retain the old interest rate for the Harriet Island Harbor project, action must be taken prior to 31 December 1969. On 24 December 1968, the Water Resources Council, which is composed of the heads of the major Federal water resources agencies, issued a Regu- lation establishing a new procedure for determining the interest rate for evaluating the benefits and costs of water resources projects. The current interest rate under the new procedure is 4 7/8 percent compared to the 3 1/4 percent rate used previously. The effect of using a higher interest rate in project evaluation, when final project design is being undertaken, varies with different projects. Generally speaking, a higher rate may make a project's overall economic justification marginal, may render one or more of its features infeasible, or may reduce its scope. Time has not permitted an accurate assessment of the effects of the higher rate on individual projects. �. If an appropriate non-Federal agency wishes to provide, before _ 31 December 1969, satisfactory assurances "to pay the required non- Federal share of the project costs" - which is interpreted to mean assur- ance that the requirements of local cooperation established for the proj- � ect will be met - then the project will continue to be evalua.ted at the previous interest rate. � Thus, if the Harriet Island Harbor project is to be eligible for evalu- t ation at the lower rate, a suitable non-Federal agency must provide me , with a statement of assurance that the following requirements of local � cooperation will be met: : a. Provide without cost to the United States all lands, easements, � and rights-of-way required for construction and subsequent maintenance � of the project and of aids to navigation upon the request of the Chief of Engineers including suitable areas determined by the Chief of Engineers "�'-� to be required in the general public interest for initial and subsequent � � disposal of spoil and necessary retaining dikes, bulkheads, and embank- ments therefor or the cost of such retaining works. '= b. Hold and save the United States free from damages that may � result from the construction and maintenance of the project. 1 � c. Provide and maintain necessary mooring facilities and utilities, � including a public landing with suitable supply facilities open to all on � ; equal terms, and dredge berthing areas to a depth commensurate with the � depth of the Federal channel improvement. d. Reserve spaces within the anchorage and mooring facilities ade- quate for accommodation of transient small boats. e. Accomplish such utility or other relocations or alterations as are necessary for project purposes. f. Establish a competent and properly constituted public body em- Y powered to regulate the use, growth, and free development of the harbor facilities with the understanding that said facilities will be open to all on equal terms. g.
