1 WEIEREAS, Neighborhood Housing & Property Improvement has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecldng and
3 removal of a two-story, wood frame stucco exteriox accessory structure dwelling located on property
4 hereinafter referred to as the "Subject Property" and commonly known as 946 Fuller Avenue. This
5 property is legally described as follows, to wit:

10 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information
11 obtained by Neighborhood Housing & Property Improvement on or before June 28, 2004, the following
12 are the now Irnown interested or responsible parties for the Subject Property: James Shelton Jr. and

17 WHEREAS, Neighborhood Housing & Property Improvement has served in accordance with the
18 provisions of Chapter 45 of the 5aint Paul Legislative Code an order identified as an "Order to Abate
19 Nuisance Building(s)" dated August 11, 2004; and

21 WHEREAS, this order informed the then known interested or responsible parties that the
22 structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and

WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by September 10, 2004; and
WHEREAS, the enfarcement officer has posted a placard on the Subject Property declaring this
building(s) to consritute a nuisance condition; subject to demolition; and
WI�REAS, this nuisance condition has not been corrected and Neighborhood Housing &
Property Improvement requested that the City Clerk schedule public hearings befare the I,egisiative
Hearing Officer of the City Council and the Saint Paul City Council; and
WAEREAS, the interested and responsible parties have been served notice in accardance with
the provisions of Chapter 45 of the Saint Paul L.egislative Code, of the time, date, place and purpose of
the public hearings; and

WHEREAS, a hearing was held before the I.egislative Hearing Officer of the Saint Paul City
Council on Tuesday, October 12, 2004 to hear testimony and evidence, and after receiving testimony and
3 evidence, made the recommendation to approve the request to order the interested or responsible parties
4 to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and
5 remove its blighting influence on the community by rehabilitating this structure in accordance with all
6 applicable codes and ordinances, or in the alternative by demolishing and removing the structure in
7 accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to
8 be completed within ffr�days after the date of the Council Hearing; and
9 WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, October 27,
10 2004 and the testimony and evidence including the action taken by the L,egislative Hearing Officer was

considered by the Council; now therefore
BE TT RESOLVBD, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order
concerning the Subject Property at 946 Fuller Avenue:
That the Subject Property comprises a nuisance condition as defined in Saint Paul
I.egislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dollars ($3,QOO.Q�).
That there now exists and has existed multiple Housing or Building code violations at the
Subject Property.
That an Qrder to Abate Nuisance Building(s) was sent to the then known responsible
parties to conect the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been cotrected.
That Neighborhood Housing & Property Improvement has posted a placard on the
Subject Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Neighborhood Housing & Property
Improvement, VacantlNuisance Buildings.
That the known interested parties and owners are as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shail make the Subject Property safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting influence
on the community by rehabilitating this structure and correcting all deficiencies as prescribed in
the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable
codes and ardinances, or in the alternative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolition and
removal of the structw must be completed within €k€teex-(�}days after the date of the Councii

2. If the above conective action is not completed within this period of 6me Neighborhood Housing
& Property Improvement is hereby authorized to take whatever steps aze necessary to demolish
and remove this structure, fill the site and charge the costs incuned against the Subject Property
pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paui, all personal
property or fixtures of any kind which interfere with the demolition and removal shall be
removed from the property by the responsible parties by the end of this time period. If all
personal property is not removed, it shail be considered to be abandoned and the City of Saint
Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties
in accordance with Chapter 45 of the Saint Paul Legislative Code.

Nei�hborhood Housing & Property Improvement has declared this buildin;(s} to constitute a
"nuisance" as defined by I.egislative Code, Chapter 45. Neighborhood Housing & Property
Improvement has issued an order to the then known responsible parties to eliminate this nuisance
condition by correcting the deficiencies or by ra2ing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Neighborhood Housina & Property Improvement that the City Council
pass a resolution ordering the responsible parties to either repair, or demolish and remove this
buiiding in a timely manner, and failing that, authorize the Neighborhood Housing & Property
Improvement to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

what he is going to undertake to bring the property back into code compliance, 2) a bond will
need to be posted by noon of October 27, and 3) evidence of financial wherewithal to execute the
rehabilitation. They can talk on October 26 about the work plan and bond. He may want to
bring his general coniractor to that hearing.
Ms. Moermond recommends laying over to the October 26 Legislative Hearing and the October
27 City Council Meeting.

The foilowing appeazed: James Shelton, 683 St. Anthony Avenue; Joyce Shelton; and William
Shalton.
Steve Magner reported he is only discussing the reaz struciure. This is a two-story wood frame
and stucco house on the rear portion of the lot. The building has been vacant since July 16, 2003.
The owners aze James Shelton, Jr. and Joyce Shelton. On August 4, 2004, an inspection of the
buiiding was conducted, a list of deficiencies which constitute a nuisance condirion was
developed, and photographs were taken. An Order to Abate a nuisance building was issued on
August 11, 2004 with a compliance date of September 10. As of this date, this property remains
in a condition which comprises a nuisance as defined by the legislative code. The vacant
buiiding fees are due. Ta:iation has placed an estimated mazket value of $38,800 on the land and
$116,300 for the building, although the $116,340 may reference both structvres on the lot. The
bond has not been posted. The estimated cost to repair is $70,000 to $50,000; esrimated cost to
demolish, $6,000 to $7,000.
Ms. Shelton stated she wanted rime to get estimates for demolition and rehabilitation. Now that
she has the compliance review and plans to get a cost for that list. Then she can come up with a
wozk plan. She has estimates from two contractors for rehabilitation. They have two estimates
for demolishing. She has talked to Mr. Senty, the inspector, a number of times. She is retired
and so is 3ames. She lives in the front house. The back house is empty. It is all the time locked.
'T'he house is unsightly, but not a nuisance. She asked for access to a list of contractors for
demolition and remodeling. She is also asking for a chance to get estimates to come up with a
good decision.
Ms. Moermond recommends laying over to the November 9legislative hearing. She will be
looking for rehabilitation plans. If the Ciry does the demolition, the assessment can be divided
over time. The owner should talk to the communiry organization in the azea. T'he Purchasing
and Contraciing Office for the City can g3ve her a tazgeted vendor list. Ms. Moermond asked if
946'/z is a legal address. Ms. Shelton responded yes. It was a delivery postal address for yeazs.

Wally I3elson appeared and stated he bought the property at the end of September. He cleaned it
out. Jim Singer (License, Inspection, Environmental Protection) went through it, his team did the
inspection, Me. Nelson puiled the bond, and he will pull the pemuts by tomonow.
Ms. Moermond asked how much time it would take. Mr. Nelson responded he wili need 180
days. The worst part is getting it pulled back together.
Steve Magner reported this is a two-story wood frame dweliing. The building was condemned 'vn
November 2003 and has been vacant since November 12, 2003. The current owner is
Renovation, Inc. There have been four suminary abatement notices issued to cut tall grass and
weeds, remove debris from porch and yazd, and remove snow and ice. On August 16, 2004, an
inspection of the building was conducted, a list of deficiencies which constitute a nuisance
condition was developed, and photographs were taken. An order to abate a nuisance building was
issued on August 18, 2004 with a compliance date of August 24. As of this date, this property
remains in a condition which comprises a nuisance as defined by the legislative code. The timing
was based on an explosion on the property; the northwest corner of the house was blown out.
The fire inspector indicated it was possible azson. The mortgage company sold the property.
Renovation, Inc. acquired the property. Vacant building fees aze paid. Taxation has placed an
estimated market value of $19,400 on the land and $81,400 on the buiiding. On October 8, 2004
a Code Compliance Inspection was done. A bond has been posted. The estimated cost to repair
is $75,006; estimated cost to demolish, $8,000 to $9,000. Jim Seeger (License, Inspections,
Environmental Protection) feels Mr. I3elson can get this property back together as per his
business.
Ms. Moermond recommends granting 180 days to rehabilitate the structute.

registrarion.
Jeff Voeller, owner, appeared.
Mike Urmann reported the building owner and he met at the site. Mr. Urmann made a
deternunation that the building should not have been condemned. They changed the status on it
to revokedlunoccupied. Their intention is to hold it in revocation due to the vacancy of the

referenced public hearings, the Saint Paul City Counci] hereby adopts the following Findings and Order

Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been cortected.
That Neighborhood Housing & Property Improvement has posted a placard on the
Subject Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Neighbarhood Housing & Property
Improvement, Vacant/Nuisance Buildings.
That the known interested parties and ownexs are as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting influence
on the community by rehabilitating this structure and conecting all deficiencies as prescribed in
the above referenced Order to Abate Nuisance Building(s) in accordance with ail applicable
codes and ordinances, or in the alternative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolirion and

3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal
property or fixtures of any kind which interfere with the demolition and removai shall be
removed from the property by the responsible parties by the end of this time period. If all
personal property is not removed, it shall be considered to be abandoned and the City of Saint
Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties

what he is going to undertake to bring the properly back into code compliance, 2) a bond will
need to be posted by noon of October 27, and 3) evidence of financial wherewithal to execute the
rehabilitation. They can talk on October 26 about the work pian and bond. He may want to
bring his general contractor to that hearing.
Ms. Moermond recommends laying over to the October 26 Legislative Hearing and the October
27 City Council Meeting.

The following appeazed: James Shelton, 683 St. Anthony Avenue; Joyce Shelton; and William
Shelton.
Steve Magner reported he is orily discussing the rear structure. This is a two-siory wood frame
and stucco house on the rear portion of the lot. The building has been vacant since July 16, 2003.
The owners aze James Shelton, Jr. and Joyce Shelton. On August 4, 2004, an inspection of the
building was conducted, a list of deficiencies which constitute a nuisance condition was
deveIoped, and photographs were taken. An Order to Abate a nuisance building was issued on
August 1 l, 2004 with a compliance date of September 10. As of this date, this property remains
in a condition which comprises a nuisance as defined by the legislative code. The vacant
building fees aze due. Taxation has placed an estimated market value of $38,800 on the land and
$116,300 for the building, although the $116,300 may reference both structures on the lot. The
bond has not been posted. The estimated cost to repair is $70,000 to $80,000; estimated cost to
demolish, $6,000 to $7,000.
Ms. Shelton stated she wanted time to get estimates for demolition and rehabilitation. Now that
she has the compliance review and plans to get a cost for that list. Then she can come up with a
work plan. She has estimates from two contractors for rehabilitation. They have two estimates
for demolishing. She has talked to Mr. Senty, the inspector, a number of times. She is retired
and so is James. She lives in the front house. The back house is empty. It is all the time locked.
The house is unsightly, but not a nuisance. She asked for access to a list of contractors for
demolition and remodeling. She is also asking for a chance to get estimates to come up with a
good decision.
Ms. Moermond recommends laying over to the November 9legislafive hearing. She will be
looking for rehabilitaYion plaus. If the City does the demolition, the assessment can be divided
over time. The owner should taik to the community organization in the azea. The Purchasing
and Contracting Office for the City can give her a targeted vendor list. Ms. Moermond asked if
946'/z is a legal address. Ms. Shelton responded yes. It was a delivery postal address for yeazs.

Waily Nelson appeazed and stated he bought the property at the end of September. He cleaned it
out. Jim Singer (License, Inspection, Environmental Protection) went through it, his team did the
inspection, Me. Neison pulled the bond, and he will pull the pemuts by tomonow.
Ms. Moermond asked how much time it would take. Mr. Nelson responded he wili need 180
days. The worst part is getting it pulled back together.
Steve Magner reported this is a two-story wood frame dwelling. The building was condemned in
November 2003 and has been vacant since November 12, 2003. The current owner is
Renovation, Inc. There have been four summary abatement notices issued to cut tall grass and
weeds, remove debris from porch and yazd, and remove snow and ice. On August 16, 2004, an
inspection of the building was conducted, a list of deficiencies which constitute a nuisance
condition was developed, and photographs were taken. An order to abate a nuisance building was
issued on August 18, 2004 with a compliance date of August 24. As of this date, this property
remains in a condition which comprises a nuisance as defined by the legislative code. The timing
was based on an explosion on the properly; the northwest corner of the house was blown out.
The fire inspector indicated it was possible azson. The mortgage company sold the property.
Renovation, Inc. acquired the property. Vacant building fees aze paid. Taxation has placed an
estimated mazket value of $19,400 on the land and $81,400 on the building. On October 8, 2004
a Code Compliance Inspection was done. A bond has been posted. The estimated cost to repair
is $75,000; estimated cost fo demolish, $8,000 Yo $9,000. Jim Seeger (License, Inspections,
Environmental Protecrion) feels Mr. Nelson can get this properry back together as per his
business.
Ms. Moermond recommends granting 180 days to rehabilitate the structure.
Appeals of Deficiency List and Vacant Building Registration Notice at 938 Sixth Street
East/623 Forest Street. (Division of Fire Prevention and NHPn
Mazcia Moermond explained that the owner is appealing the list and the vacant building
registration.

Mike Urmann reported the building owner and he met at the site. Mr. Urmann made a
determinafion that the building should not have been condemned. They changed the status on it
to revoked/unoccupied. Their intention is to hold it in revocation due to the vacancy of the
