2 WHEREAS, the Department of Planning and Economic Development is presently
3 conducting a small area plan study and 40-acre study of the Sun Ray-Suburban area pursuant to
4 an interim ordinance adopted in Council File No. 02-1115; and

WHEREAS, the said study may lead to the adoption of amendments to the City's
comprehensive municipal plan and to its official zoning controls within the Sun Ray-Suburban
area; and
WHEREAS, a public heazing on proposed zone changes has been set for February 4,
2004; and
WHEREAS, the interim ordinance regulations established in Council File No. 02-1115
will expire before any recommended changes to the zoning controls for the Sun Ray-Suburban
area contained in the said study could be adopted and made effective under the provisions of the
City Charter and this has the potential to permit development within the Sun Ray-Suburban area
that would be incompatible with the said study's recommendations; and
WHEREAS, under a sepazate ordinance, the Council of the City of Saint Paul intends to
extend the regulatory effect of the interim ordinance set forth in Council File No. 02-1115 for an
additional six months in order to preserve the status quo with respect to land use and to protect
the general health, welfare and safety of the public within the Sun Ray-Suburban area in order to
protect overall vision for this pivotal area as set forth in the said study pending the Council's
final action regarding the adoption of recommendations presented in the said study;
26 NOW THEREFORE, BE IT RESOLVED, that under a separate ordinance, the Council of
27 the City of Saint Paul intends to extend the regulatory effect of the interim ordinance set forth in
28 Council File No. 02-1 ll 5 for an additional six months as provided in Minn. Stat. § 462355,
29 Subd.(4); AND,

31 BE IT FURTHER RESOLVED, that pending the adoption of an ordinance e�tending the
32 regulatory effect of the interim ordinance in Council File No. 02-1115, no zoning or building
33 permits, plat approvals or lot splits may be issued or approved, unless exempted as provided
34 under the terms set forth set forth in Council File No. 02-1115 or any duly adopted amendment
35 thereto in that same separate ordinance noted above, from this date and until the expiration of
36 eighteen (18) months as allowed by Minn. Stat. § 462355, Subd.(4), or until such earlier time as
37 the Council of the City of Saint Paul has taken action on the recommendations contained in the
38 study; AND

4 BE IT FURTHER RESOLVED, until such time as the said study has been completed and
5 the Council has reviewed its recommendations for possible adoption, city departments receiving
6 written applications for the approvals noted above shall accept the applications and immediately
7 process them in accordance with the provisions of Minn. Stat. § 15.99, Subd. 2 and with the
8 intent of this interim ordinance; and

10 BE IT FINALLY RESOLVED, that the restrictions contained in this resolution, in the
11 interim ordinance in Council File No. 02-ll 15 and any ordinance duly adopted which eatends its
12 regulatory effect, may also be eatended by action of this Council for additional time periods not
13 to exceed the total time provided in Minn. Stat. § 462.355, Subd. (4), in the event such study and
14 recommendations and the deliberations of the Council require such time extensions.
