RESOLVED, That the proper officers of the City of Saint Paul are hereby
authorized to pay to F. Morettini Construction Company on Fartial Estimate No. 1,
Contract No. L-7199, Froject No. S-1345, for the construction of CIiILD3 RO�D
SANITARY SL�R, said estimate being paid for the period of Noveeber 10, 1969 to
Dece�ber 1, 1969, and such other partial estimates on said contract that �ay be
presented subsequently by said Contractor and approved by the City Engineer, it
being the understanding of this Council that such partial paymment or payments on
partial estimate or estiuiates on said Contract in no way are to be construed as
an act by the City or any of its agents, servants or employees extending the
�� ti�e specified for the cocnpletion or in any way changing the ter�s of said contract,
� plans or specifications thereof, nor in any way nor by any �eans shall this resolu-
�` tion or pay�ent, or pay�ents made und�r authority of this resolution be construed
(
as a waiver of any of the ri�hts of said city under ssid contract, and pro�ided
that prior to payment of any of the aforesaid partial esti�ate or estimates, said
contractor by its duly suthorized agents or corporate officera shall file with
the City Coe�ptroller in a forn� approved by the Corporation Counsel an acceptance
of the conditions of payment as hereinbefore set forth, and
BE IT FURTHER RESOLVED, That in the absence of said acceptance being filed
with the City Comptroller, no payment or payments as aforesaid shall be made.
