Mr . 0'Brien appealed a letter of the Building Department dated
November 4 , 1969 indicating tliat the proposed enclosures on tlie
second floor level of the University Club, 420 Summit /�venue would
iiot provide the proper means of egress and protective exit way
from the upper floor of the University Club ,
Mr . Cohen moved that Mr. John Talbot , Chief of the Fire Preventi.on
Bureau, examine the proposed plan relative to the fire exi.ts Erom
the first and second floors of the University Club, 420 Summit t�ve . ,
ancl that the Board grant variance to Section 5-1121 of the Lif�e
Safety Code adopted Uy the St . Paul City Council by reference upon
written approval of the exit way proposed by Mr. John Talbot .

Case No . 58 368-370-372 Goodhue (Charles Andreen) , continuecl
I�fr. Anderson stated that Mrs . Andreen had called his office and
said that Mr . Andreen could not appear before the Board today as
lie would be out of town but that he could be present at the next
regular meeting of the Board to be held on November 26 , 7969.
Mr . Cohen therefore requested that the matter be continueci until
the next regular meeting of the Board.
Case No . 60 665 E. 4th Street (Jake Croymans)
Mr. Jake Croymans appealed a letter of the Bureau of. Health clated
October 6 , 1969 relating to Housing Code violations at 665 E. 4th St .
Mr. Voigt moved that the filing fee be waived for the appeal i'or
665 � . 4th Street . �Ie further moved that Section 54 . 11 paragraphs
1 - 3 of the St . Paul Legislative Code , requiring that each dwelling
unit have its own bathroom, be waived for 665 E. 4th Street on the
condition that each dwelling unit on the second floor be limited
to one tenant only and that no more than three tenants l�e allowed to
share the bathroom on the second floor and that no more. than fi.vc;
tenants be allowed to share the bathroom on the first :Eloor. lle
also moved that the premises be reinspected by an electrical iri-
spector to determine the number of aclditional electrical outlets
neecled to make the wiring safe and that the ]3oard waive tlie rec�uirc-
ment for any additional electrical outlets that may be rec{u:ired by
Code , according to the electrical inspector ' s recommendations .

Such waiver is to be granted until such time as the property at
665 E. 4th Street be sold or the ownership be transferred, at which
time a11 Housing and Building Code Standards be conformed with ancl

Mr . Lamey appealed a letter dated October 15 , 1969 of the l3ureau of
Health along with an Order to Vacate dated October 15 , 196� anci a
Notice of Condemnation dated October 15 , 1969 which also includecl
lists of needed improvements dated December 3 , ].969 - all relatin�
specifically to 68 Wilkin Street .
Mr. Cohen moved that the Order to Vacate be extended for a period o1'
30 days , from November 15 , 1969 to December 15 , 1969.

Case No . 62 750 Curfew (Donald R. Doerfler)
Mr. Doerfler appealed a letter of the Bureau of Health clated
September 23 , 1969 whicli enumerated items not in compliance with
the St . Paul I-Ious ing Code .
Mr . Cohen moved that the matter be rescheduled for hearing after
30 days at which time Mr. Doerfler submit to thc ]3oarcl a plan :for
an approved fire escape along with an estimate of cost f.or suc11
fire escape, keeping in mind that the variance may not be graritecl
even if this is done .

Mr. Gulbranson appealed a letter of the Bureau of fiealth aat�:a
October 7 , 1969 concerning the discontinuance of a. third �loor
occupancy at 1414-1416 Englewood Avenue .
Mr . Cohen moved that the third floor occupancy at 1414-1�1fi L'n�;lc-
wood nvenue be permittecl to continue , in variance of 5ection 5�1 . 15
paragraph 3 of the St . Paul Legislative Code , on the coricl.it.i.oii th�it
an investigation by Mr . Anderson finds that a building permit was

- Englewood. Such variance is to be granted until such time as the
property at 1414-1416 Englewood be sold or the ownership transferrcd,
at which time the third floor be vacated and the buildin� conform in
all respects with the Housing and Buildin� Code Stanclards with no
variances .

Dennis Schaefer and Donald Opp appealed a letter of• t}ie 13ureau of
Public Buildings , dated August 11 , 1969 , relative to an ille�*al
third floor occupancy at 1650-52 Ashland Avenue . �
Mrs . Sommerdorf moved that the third floor occupancy at 1650- 52
Ashland be permitted to continue, in variance of Section 54 . ]_5
paragraph 3 of the St . Paul Legislative Code on the condition that
the third floor apartment be occupied by one of the two owners ,
Mr. Schaefer or Mr. Opp and that such variance be granted until
such time as the property of 1650-52 Ashland be sold or the owner-
ship be transferred, at which time the third floor be vacatecl and
the building conform in all respects to the Housing ancl Building
Code standards with no variance .

Case No. 68 1753 Randolph Ave . (Bernard J. Sa�;stetter)
Mr. Voigt moved that the filing fee concerning the appeal for
1753 Randolp:h be refunded.

Mr . Sagstetter appealed letters of the Bureau of Public Buildings
dated January 15 , 1969 and July 25 , 1969 concerning a certificate
of occupancy for a 4 unit apartment at 1753 Randolp� Avenue . Mr .
Cohen moved that the requirement , as stated in the letter of
January 15 , 1969, that the basement stairway at 1753 Randolph
Avenue be enclosed at the bottom with a partition and cioor, be
waived on the condition that the following items be done to comply
with the Building Code :
1 . Install two sprinkler heads in the boiler
room area under the ceiling joists .

2 . Provide proper doors between the stairway
and the apartments to comply with Sect�.on
605-2-e of the St . Paul Building Code .

Burnett)
Mr. Burnett appealed a letter of the Bureau of Public 13u,ildings ,
dated November 5 , 1969, concerning a violation of Article 51.1 -2 ,
paragraphs a and b of the National Electric Code in connection witt�
the proposed construction of the Northwestern Bell Telephone Co .
building at 223 Plato Boulevard. .
The Board agreed that George Smolik, city electrical inspector,
be contacted to see what specific recommendations he woulcl make
in order to accommodate this proposal . Mr. Anderson is then to
contact members by phone and poll them as to their votc, �;ivin�;
consideration to Mr. Smolik' s recommendations . .
The minutes of the meeting of October 22 , 1969 were approved as .

ADDENDUM TO THE MINUTES
ST. PAUL BOARD OF APPEALS
November 20, 1969 �
, Case No. 70 223 Plato Boulevard (Volp Construction Co . ,
Glenn Burnett)
Mr. George Smolik, city electrical inspector, was contacted
according to the request of the Board of Appeals at; its meetin�
of November 12 , 1969 concerning his recommendations as to the
appeal for 223 Plato Boulevard by Volp Construction Co . IIe re-
quested that Volp Construction Co, submit , in writing, engineering
specifications concerning the proposed ventilation system that
would be installed at such address .
In a letter dated November 13 , 1969 to Volp Construction Erom
Fred Vogt and Co , such specifications were set forth .
Tn reply to this , in a letter dated November 12 , 1969 from
Robert Ames , City Architect to Volp Construction Co. it was ex-
plained that the design of the proposed vent system was not
fully satisfactory due to added makeup air and the possibility o:E
a mechanical breakdown of the system. It was pointed out that the
necessary margin of safety would be reasonably assured by making
the office floor at least 4" above the garage floor .
Members of the Board of Appeals who were present at the meetin� of
November 12 , 1969 were then contacted by phone on NovemUer 20 , 196�
and apprised of the foregoing facts and conclusions . On the basis
of said facts and conclusions , Mr. Lawrence Cohen, C}iairman of
the Board of Appeals moved that Article 511- 2 of th'e National
electrical code be waived for construction of the building at
223 Plato Boulevard according to the proposed plans and under the
following conditions :
1 . That the ventilating system as proposed be installed.

2 . That the office floor Ue constructed at least four
inches above the garage floor.
