1 WHEREAS, Neighborhood Housing and Property Improvement (NHPn has requested the City
2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate
3 for a duplex rental property located at 49 Dale Street North and registered to John/Ann Zappia and
4
WHEREAS, on June 4, 2004, NHPI conducted an inspection of said property and issued
Correction Notice for maintenance exterior with a compliance deadline of July 15, 2004; and
WHEREAS, on July 19, 2004, NHPI conducted a reinspection of said property and found lack of

compliance with the previous order; and
WHEREAS, on July 21, 2004, NHPI sent the holder of the rental registration certificate for the
subject properiy, John/Ann Zappia, a$50 excessive consumpfion bill, addressed to 4800 Dowling
Avenue, St. Paul, MN 55406 the address on said certificate; and
WI�EREAS, as of September 28, 2004, said $50.00 has not been paid, and Legislative Code
§51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate
revocation;and
WHEREAS, on July 21, 2004, NHPI notified John/Ann Zappia of the need to arrange an interior
inspection of the subject property; and
WHEREAS, as of September 28, 2004, an interior inspection has not been arranged, and
Legislative Code §51.07 (a) (iii) provides that the imposition of an excessive consumption fee is grounds
for an interior inspection, and
WHEREAS, on September 28, 2004, NHPI sent John/Ann Zappia the proper Notice of Intent to
Revoke Rental Registration (copy attached); and
WI-IEREAS, John/Ann Zappia has not appealed said notice and the time for filing an appeal has
expired; now therefore
BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
following findings and order concerning the subject property at 49 Dale Street North.
That the subject properiy is a duplex rental properiy that is required to be registered with
the City's Rentai Registrafion Program.

That said certificate holder has been billed for excessive consumption of code inspection
services, which bas not been paid.
That said certificate holder has been requested to allow an interior inspection of the
subject properry, which has not been arrauged.
That the nofification requirements of Chapter 51 have been fulfilled and the time for an
appeal has expired without an appeal being made.

The Saint Paul City Council hereby makes the following order:

The above-referenced Rental Registration Certificate issued John/Ann Zappia for the
duplex rental property at 49 Dale Street North, Saint Paul, MN is hereby revoked.
It is further ordered that a copy of this resolution be mailed to John/Ann Zappia.
