Dear Sir:
This is written in response to the appeal of Phalen Park State Bank to
relax the setback and buffer provisions of the Zoning Code as they apply
to property located on the northeast corner of Maryland and Prosperity
Avenues. This property is further described as the east 20 feet of Lot
16, Nilsson's Subdivision of Lots 9 and 10, Block 4 of Rogers and Hendrick's
Acre Lots No. 2.
This matter was considered at the July 3, 1969 Board of Zoning meeting.
The staff reported that the appellant desires to make maximum use of the
property for bank parking and therefore is requesting that the setback
requirement along Maryland Avenue be relaxed and than an eight foot
buffer requirement at the northeast corner of the site be relaxed. It was
noted that the applicant has agreed to construct a 2.5 to 3 foot high
decorative pall where the parking lot faces Maryland Avenue.
Mr. Raymond Faricy, representing the bank, explained their proposal, noted
their intent to provide the three foot wall and planter, and also stated
that the Bank. is trying to buy the dwelling adjoining the bank parking lot.
Subsequently, it was the finding of the Board of Zoning that the bank
needs the additional off-street parking and that the requests are reason-
able. Therefore the Board of Zoning unanimously recommends approval of
both appeals,

Mr. Raymoad Faricy, Jr. said they have a time problem because of
Che Banking Cos�ission. Their lease rans out aC their present
locatian oa July 1; t[ae ne�w bui�.ding has bean constructed and
they woald like to have the drive•in cansidered now, and the
parking facility later. He sa�d their plans are the same as
when they rezoued the praperty.
Mr. Soreason said th�re is �n alley vacatian pending, the existing
uaimproved alley runs through the property and the appli.cant is
dedicating a new alley - the public hearing is July 23. Mr. Faricy
said they are agreeable to al� su�gestions eaccept thoae they were
appeaZin� on. Mrs. l�i. Hutchinson iaquired about the aZley aad
Mr. Faricy answered her queation.
Mr. Sorenso� read a letter fram Captein Anderson r�lativ� to traffic
conditious in this ares. The Traffic Dept. has indicated there mey
be a traffic signal regulating left-hand turns at this interaection
in the future.
Mr. Gauger moved for approval of the drfve- f�cility• motion
secanded by Mr. Gndler and cArried unanimous

PHALEN PAR�C STATE BANK: An appeal to relex the parking lot buffer setback
requirements aad waive aetbeck provisiona on property loceted on the north-
east coroer of W.aryland and Prosperity. Mr. Sorenson stated that the Board
hed reco�ended approval of the drive-in banking facility. The area to be
developed wi21 permit the parking of 15 cars; 4 of these will adjoin the
rear yard of residential property and necessitates an 8' buffer area.
Mr. Rsymond Faricy, the attorney representing the bank, said the bank is
trying to buy the one-femily dwelling behind the bank. He said the bank
will provide a 3' wall and plenter on the Maryland Avenue frontage.
A represeutative from the bealc stated that birse Hutchinson, who livea
behind the bank, doea not want any fence built for a bu£fer because ehe
prefers to view the bank.
Mr. Maietta moved far approval of the setback provisions as the requeat was
reasonable, subject to the construction of the wall and planter. Mr. Cohen
secoreded the motion, and it carried unanimously.
Mr. Danna moved €or approval of the appeal to waive the buffer requirement
as there was no opposition and the bank needs the additional off-street
parking space. Mr., Maietta secoaded the mation, and this also carried
ananimously. Mr. Gadler said he is normally oppoaed to variances, but
inesmuch as there is no opposition from neighbor , h�voted his approval.
