THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l. That the Zoning Code, Chapters 60 to
64, inclusive, of the Saint Paul Legislative Code, pertaining
to Use Districts, Height Districts and Rezoning of certain
properties in the City of Saint Paul, as amended, be and the
same is hereby further amended so as to rezone the following
described property from "A" Residence District to "C-1"
Residence District, to—wit:
Lot l, except the North 40 feet thereof,
and all of Lots 2, 3, Block 3, Hudson
Road Gardens;
situate on property located on the west side of Haze1 Street
between Con.way Street and Wilson Avenue in the City of Saint
Paul.
Section 2. This ordinance shall take effect aztd be
in force thirty (30) days from and after its passage, approval
and publication.

Dear Mr. Marshall:
This is written in response to the petition of Richard J. Coverdale to
rezone from "A" to "C-1" Residence property located on the west side of
Hazel Street between Conway Street and Wilson Avenue. This property is
further described as:
Lot l, except the North 40 feet thereof, and all of
Lots 2, 3, Block 3, Hudson Road Gardens.
This matter was considered at the August 7, 1969, Board of Zoning
meeting. The staff reported that areas to the southeast have recently
been rezoned to "C-1" Residence and that a staff study of the area indicates
that a medium-density residential use at "C-1" density would be proper for
this site. The staff study indicated, however, that the northerly portion
of this block should be reserved for single-family or duplex development.
It was noted that the maximum units allowed if the rezoning is granted
would be 56, while the staff's study plan would allow 51 units including
se�veral duplexes. The staff explained that by using the south side of
Conway Street for duplexes a good land-use progression would be provided
and the single-family uses on East Third Street would be protected.
Mr. Gerald Frisch, representing the applicant, stated that they are in
accord with the staff's recommendations, except on Conway it is extremely
poor soil and would take considerable money to fill the land. He stated the
applicant plans to leave 100 feet to the east of the site across Hazel Street
to be able to condense the area to be filled. Two buildings of 28 units each
are to be constructed. There will be two-to-one parking ratio on the proposed
site. He also noted that the 40-foot strip along the south side of Conway
Street would be filled and landscaped with trees in accordance with the staff's
standards, but not used except for green area--to be used as a buffer.

Enclosed herewith please find Affidavit of Richard J. Coverdale
in connection with rezoning Petition for property on the west side of
Hazel Street between Conway Street and Wilson Avenue. You will note that
the Affidavit sets forth that the property may be rezoned as "C-1" Residence
District.
I have been in touch with Mr. Paul Kelly of Corporation Counsel's
Office. It is my understanding that this Affidavit will be adequate to
clarify the record and submit the matter to the City Council as a rezoning
to a "C-1" Residence District.

states as follows:
That on or about December 21, 1968, he circulated the attached
Petition to rezone the following described property, to-wit:
Lot One (1) , except the North Twenty (20) feet
thereof, and all of Lots T�vo (2) and Three (3) ,
Block Three (3) , Hudson Road Gaxdens.
That at the time he circulated said Petition he had informed the
owners of adjoining property that he inte�ded to cause the property to be
rezoned for an apartment development. That at no time did he discuss the
specific classification of the rezoning district, na�ely, either "C" District
or "C-1" District.
That thereafter on or about April 15, 1969, he circulated an addi-
tional Petition covering the Southwest corner of Hazel and Conway, described
as Lots One (1) , Two (2) and Three (3) , Block Three (3) , Hudson Road Gardens
Addition, and obtained thereon signatures of Alfred J. Tetzlaff and Eleanor M.
Tetzlaff. That the last mentioned Petition designated the rezoning thereon to
a "C" Residence District.
That at the time of filing Petition o� December 21, 1968, your affiant
changed the Petition to a "C" Residence District in lieu of a "C-1" Residence
District designation.
That your affiant is agreeable to submitting the said Petition of
Dece�ber 21, 1968, an its original condition, aamely, a Petition for a "C-1"

PRESBNTs Messrs. Ames, Denna, Ganger, McPartlin� and Maietta of the Board and
Messrs, Brown and Sorenson and Miss Poechmsnn of the etsff.
RICHNRD Jo COVBRDALE: A petition to rezone from "A" to "C•1" Residence to permiC
construction of apartments on property located on Che aoutheast corner of Aszel
Street and Conway Street.
Mr. Sorenson su�narized the staff report stating Chat the aite has 320 fcet along
undeveloped Hazel Street with a depth of 297.34 feet and aquare footage of
95,148.8. The ad3acent properties are soned "A" Residence; north of Wilson
�venue between �iezel Street and Luella Street two large tracts were recently
rezoned to "C-1" Reaidence. The Comprehensive Plan recou�mende low-deneity
development for the site and the adjacent properties inclnding the one recently
rezoned. The subject site is vacant, has denae brush and undergrawth, and ia
relatively level. Zt is much lower than Van Dyke Street, Bast Third Street. and
Wilson Avenue. Wilson Avenue is paved and Hazel Street is paved from Wilson south
to Old Hudson Road. All other ad3acent platted atreets are non-exiatant. Aa
apartment ie under consCruction on the northeast corner of Wilson Avenue and
Hazel Street. Mr, Sorenson stated that the atsff has studied this sres, sad
then explained a proposed development akeCch, a part of the file. He noted that
apart�nenta at "C-1" density would be proper for the majority of this aiteo but
that the first 120 feet fronting on Che south side of Conway ahould remain for
low-density develop�ent and not be resoned. He noted that uader the proposed
aket�h plan the three lots could be developed with a total of 51 units insteed
of a maxim�nn of 56 allowed if the rezoning is granted.
He gave the following conclusions: 1� recent rezonings indicate a change in the
character of the area and the Comprehensive Plan which origiaelly called for
park apace; 2) public improvements for single-family development in this area
are high; 3) topographical, not geological, featurea in the srea acted as a
deterrent to low dens�ty development of the ares; 4) Lot 1 should retain its
present classification as ahould all those lots abutting Conway Street in this
area; and 5) Lot 1 can be divided for low-density use under "A" Resideace.
Mr, Idaietta wanted to know if these ia a definite reason for cul-de-saca, Storm
aewers are in oa Iiazel Street. Improvements are needed on Van Dyke, Aazel,
Luella, etc. A new street could be platted between �ihite Bear Avenue and Van
Dyke, south of Conway snd north of Wilson.
Mr. GeraZd Bo Friach represented the applicant and atated that ehey are ia accord
with the sta.ff's recomnaendatious, except on Conway it is extremely poor eoil and
would take considerable money to fill the land. He stated the applicaat plans to
leave 100 feet to the eest of the aite across Hazel Street to be able to condense
the area to be filled. Two buildings of 28 units each are to be constructed,
There will be two-to-one parking ration on the proposed site. They passed around
two pictures of the afte taken in the wiater. The 40-foot strip would be filled
and landscaped with trees in accordance with the ataff's standarda, but not ueed
eucept for green area--to be used ss a buffer.

Mr, McParClin said it would continue to be "A" Residence and that ehe Boaxd is
not concerned with that property at this time.
Mrs. Marie Chatterton, I882 East Third Street. queationed whether an alley would
be behind the apartments. Mra Sorenson said no alley is platted.
Mr, Clarence Fincel, 1.890 East Third Street, expressed concern about a trsffic
problem. Mr, Maietta ca�ented that rhe apartment tenants would came off Old
Hudson Road oato Haze1 Street. Mr. Shea said there is no access Co Conway Streeto
Mra, Chatterton noted there ia a big hill in the vicinity and is worried about
more accidenta occurring.

The attached petition of Richard J. Coverdale to rezone from "A" to "C"
Residence property located on the west side of Ha�el Street between Conwaq
Street and Wilson Avenue is being returned to your office without consider-
ation or recommendation from the Board of Zoning.
This action is taken in response to a legal opinion dated May 8, 1969 from
the Corporation Counsel's office which responds to the concern of amendments
to the petition without apparent recirculation. The legal opinion states
in part: "It would be my opinion that this petition should be accompanied by
a sworn affidavit of Richard Coverdale that the petition was amended prior
to receiving any signatures thereon. If the amendment was made after any
signature was placed on the petition, the petition would be invalid and there-
fore necessitate recirculation."
