03-1142� =- __ , .��1l�rr i'�'.1� - Presented By `��, /� ���� RESOLUTION CITY OF SAINT PAUL, MINNESOTA Referred To Council File # ���,�� Resolution # Green Sheet # 1 o U �2 � �.� Committee: Date 35 Z Request for Additional Work Related to TN Zoning and Zaning Code Refurmatting 3 5 WHEREAS, the Mayor and the Planning Commission have submitted and recommended adoption of a majar 6 revision of the Zoning Code (Saint Paul Legislative Code, Chapters 60 through 69) on which the Council held 7 a public hearing on December 3, 2003, and received ad@itionai written testimony unti] December 10, 2003; 9 WHEREAS, the major revisions do the following: reorganize the Zoning Code to make it easier for 10 everyone to find the regulations they are looking for; provide Traditional Neighborhood zoning districts for 11 mixed use, "urban village" development; and codify design standards that have been recommended in the 12 Comprehensive Plan; 13 14 WHEREAS, the Council recognizes that the Zoning Code revisions contain many useful improvements—for I S example, the tables of permitted land uses that are convenient for internet users--and wants to thanks the 16 17 18 19 20 21 22 23 24 25 26 27 Planning Commission, the staff, and the citizens who did the work and participated in the process of creating the Zoning Code amendments; WHEREAS, the Council has 1sQ found through the public testimony and discussions with constituents that, for certain of the amendments contained in the Mayor's and Planning Commission's draft ordinance, there is not sufficient community awareness and support for the Council to act; instead, there should be more community discussion and participation to consider alternatives and seek broader consensus; WHEREAS, the Council wants both to act on the large sections of the proposed ordinance that have generai support but also to request fiirther work on the issues and questions that arose through the CounciPs deliberations; 28 NOW, THEREFORE, BE IT RESOLVED, that the Council requests that the Planning Commission and 29 the staff do further work on the following issues: 30 31 l. 32 33 2. 34 35 3. 36 37 38 4. 39 Carriage houses; Secondazy dwelling units; Parkland dedication in TN zones andlor fees in lieu of parkland dedication (with participation by the Parks and Recreation Commission and staff and by the Friends of the Parks and Trails); Interrelationships between the T'N zones and River Corridor Overlay zones, and in particular development of height regulations for the River Corridor Overlay zones as called for in the Mississippi 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 b5 66 67 68 69 70 71 72 73 74 River Corridor Plan chapter of the Comprehensive Pian (with participation hy the DNR, parks�d -`, � Recreation, the Design Center, and interested citizen organizations); 5, jj�,$htrPm�lati ++ f.,=�� ,,,, Ti '� c'tt e�,,,,T Method measuring the size of double— sided signs -- whether to count one side, or both sides, or to devise some alternative formula 6. Attachment of reasonable conditions to zoning permits and variances that will ensure future compl73�ce with City regulations and will, if necessary, facilitate enforcement; and BE IT FURTI3ER RESOLVED, that these tasks be conducted with opporiunities for discussion and with public input by affected City depat�tments and advisory bodies, other interested public agencies, district councils, business organizations, cityrvide organizations, and the general public; and FINALLY RESOLVED, that the Council requests the Planning Commission and PED staff to make a progress report back to the Council six months after the date of this resolution. If these are amendments that the City Council wants to adopt, they are in the correct form and use the correct terms. liowever, these amendments are not recommended or supported by staff.
