WHEREAS, Pursuant to Minnesota Statutes §462.357 and §64.400 of the Legislative Code, Leonard & Barbara
Paczosa duly petitioned to rezone the west 15.6 ft. of 1194 Maryland Avenue, being legally described as That
part of Lot 4 lying east of the West 30 feet thereof and that part of Lot 3lying west of the East 42.34 feet
thereof, all in Block 1, Lane-Hospes Addition, Ramsey County, Minnesota, from R-4 One-family Residential to B-
2 Community Business for expansion of service station/car wash, the petition having been certified by the
Planning Division on August 29, 2003, as having been consented to by at least 67 percent of the owners of the
area to be rezoned, and further having been consented to by at least two-thirds of the owners of the property
situated within 100 feet of the total contiguous property within one year preceding the date of the petition; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on October 2, 2003, for
the purpose of considering the rezoning petition, and pursuant to §107.03 of the Administrative Code, submitted
its recommendation to the Planning Commission for approval; and

all interested parties were given an opportunity to be heard, the Council having considered all the facts and
recommendations concerning the petition; now, therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet Number 6, as incorporated by reference in §60.301 of the
Saint Paul Legislative Code, as amended, is hereby further amended as follows:
That the west 15.6 ft. of 1194 E. Maryland Ave., between Duluth and Lane Place, being more particularly
described as:
That part of Lot 4 lying east of the West 30 feet thereof and that part of Lot 3 lying west

WHEREAS, Leonard & Barbara Paczosa, File # 03-351-245, under the provisions of §60.540
and §64.400(b) of the Saint Paul Legislative Code, have applied to rezone that part of Lot 4
lying east of the west 30 feet thereof and that part of Lot 3 lying west of the east 42.34 feet
thereof, Block 1, Lane-Hospes Addifion, part of current Parcei identification Number (PIN) 28-
29-22-0006, at 1194 E. Maryland Ave., from R-4 One-famify Residentiai to B-2 Community
Business for expansion of service station/car wash; and
WHEREAS, the Zoning Committee of the Pianning Commission, on October 2, 2003, heid a
pubiic hearing at which all persons present were given an opoortu�ity to be heard pursuant to
said application in accordance with the requirements of §64.300 of the Saint Paul Legislative
Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to its
Zoning Commitfe= a± the public hearing as substaniialiy reflected in the minutes, made the
following findings of fact:
1. The applicant wishes to expand the existing convenience store and add a car wash to the
business at 1184 E. Maryland. The applicant also owns the property to the east at 1194 E.
Maryland. He is proposing to take 15.6 ft. from the residentiai Iot and attach it to the
commercial lot in order to accommodate the expansion.
2. The proposed rezoning is compatible and consistent with existing and proposed
development in the surrounding area. The proposed expansion can be developed in a way
that is compatible and consistent with the surrounding area. The expansion will require a
new conditional use permit and site pla.n. re�rie�a, which wi!i er�sur2 that the additions fii in wiih
the surrounding uses.
3. The proposed rezoning is consistent with the Comprehensive Plan. The generai policies of
the comprehensive plan place a high priority on ensuring thaf land resources with potential
for business use are made available. Expanding the commercial zoning 15.6 ft. to the east
wiil retain a conforming residential use and permit the expansion of the business.

Chair Morton reported that on Tuesday, Saint Paul lost a leader and a friend wich the death of
Councilmember Jim Reiter, from Ward 5. She stated that his commitment and leadership are
going to be greatly missed in t�'�e City. She said he had a great sense of humor and he always
was able to put the issues in the right perspective. Chair Morton asked the Planning
Commission members to join her in a moment of silence to remember Jim. She announced the
funeral azrangements.

there was one letter in opposition.
Leonard Paczosa, the applicant stated their business is so small they would like to expand to make the
business profitable. He submitted a letter from a neighbor in support.
Ron Hanson, 1167 Lane Place, stated he was in favor of the rezoning.

The public hearing was closed.
Commissioner Kramer moved approval of the rezoning. Commissioner Faricy seconded the motion.
At the question of Commissioner Kramer, Ms. James stated there will be a site plan review meeting on
October 15, 2003, and there wili be an opportunity to make changes in the future.
Commissioner Kramer suggested that the west bound entrance should be moved further to the south as to
eliminate the traffic on Maryland.
The motion passed by a vote of 7-0.

The Mini-Pac business has been an important part of the Payne-Phalen area of Saint Paul. This
business provides needed jobs for the local community, and a needed service for the
neighborhood. I support their efforts to expand the store in any way they see fit with the
property that they own. Lenonazd, Barbara, Eric, and Jeremy have been wonderful neighbors,
and their Mini-Pac store with a canvash wouid be a welcome addition.
