WHEREAS, The Council o� the City of Saint Paul, by
resolution, C. F. No. 244705, approved July 1, 1969, did
vacate a portion of Abell Street, said vacation
reserving to the City of Saint Paul and other public
instrumentalities the public utility easements contained
therein and thereon; and
WHEREAS, Amoco Chemicals Corporation has requested
that the Council waive said retained ease�ments, and the
affected City departments, Northern States Power Company
and Northwestern Bell Telephone Company have filed
written certificates of intended non-use of reserved
rights and easements, which certificates are attached
hereto; now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul,
pursuant to Section 228.05 of the Saint Paul Legislative
Code, as amended, does hereby waive the retained easements
contained in resolution, C. F. No. 244'705, approved July l,
1969, in the following described property, subject, how�ver,
to the continued retention of a 30 foot easement to protect
the in place water main, said easement being 15 feet on
either side of a line which is parallel to and 20 feet
east of the west line of Abell Street and extending from
the north line of East Hawthorne Avenue to a point 175
feet north of said north line of East Hawthorne Avenue:

Abe11, Street from the northerly line of Ea,st Hawthorne Avenue
to a point approxi.mately �+u0 feet northerly of said avenue. '

The portion of Abell Street petitioned to be vacated is 60 f�et in width by
?+60 feet in length and contains approximately 27,600 square feet. The
abutting lands along the entire area described in the petition are zoned
light and heavy industrial and �ave been assembled into a site for
industrial development.
The north 325 feet of Abell Street petitioned to be vacated, was deeded
tc the City of St. Paul on June 9, 195�+, and accepted per C.F. 169273,
approved July 13, 195�+• The deed to the City contains a reversion
clause specifica],1.y stating that upon cessation of use of' said land for
street purposes, said land will be added to and become a part of the � '
abutting property to the east and west, sazd addition to be divided eque,lly �
half and half. The remainin ;

The Water Department presently has a 12 inch water main in the street ending I
approxi.mately 175 feet north of the north line of East Hawthorne Avenue �'
and being located 20 feet east of the west line of Abell Street and re-
quests retention of an easement �o protect their interests.

The staff report of the City Planning Board makes mention of a s �"
major road along the west side of the Soo Line Railroad traeks as proppsed �.,

by the Comprehensive Plan and the Metropolitan Thoroughfare Syst�p, which
runs throu the �
� petitioners property and f'urther s�ggests that al.lowance �a
for the proposed road be allowed for in subject vacation.

granted. subject to the following terms and conditions:
1• That the �escription of the portion of Abell Street peti�ioned to be
vacated be described as follows: A11 that part of Abell Street ly�.ng
between the north line of East Hawthorne Avenue extended and a line

Avenue.
2. That the vacation be subject to a11 the terms and conditions of
