Marshall City Clerk Room 386 City Hall Dear Mr. Marshall: This is written in response to the appeal of Arlington Properties to relax the required 30' setback requirement from Sylvan Street to 20.5� , and the application for a 37-car parking lot to be used in conjunction with a 28-unit apartment building. This property is located on the southwest corner of Arlington Avenue and Sylvan Street, and is further described as follows: Lots 26 through 30, Block 1, Hagens Subdivision of Lots 1 through 7, and 14 through 18, of Wallcott's Addition to Cottage Homes. This matter was considered at the June 5, 1969, Board of Zoning meeting. The staff reported that the application for a parking lot permit meets the design standards and that the Traffic Engineer has approved the plans. In the matter of the appeal to relax the setback requirements of the Zoning Code it was reported that a setback of 30' was required from Sylvan Street, as determined by the adjoining "A" Residence District. The side yard setback from Arlington Avenue is only 4' . The appellant is requesting a setback of 20.5' from Sylvan Street and is providing a setback of 20' from Arlington Avenue. It was reported that the requirements of the Zoning Code were reasonable, the requested variance is excessive, the required setback allows for adequate open space which is deficient in the proposed development, and the appellant claims no peculiar conditions existing on the site that would present a hardship to develop the site to comply with the Zoning Code. After considering the appellant's request and noting the additional setback from Arlington Avenue, it was moved that the requested appeal and the application for a 37-car parking lot be recommended for approval.
