THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Sectio�. l. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining
to Use Di�tricts, Height Districts and Rezoning of certain
properties in the City of Saint Paul, as amended, be and
the same is hereby further amended so as to rezone the
following described property from "A" Residence District
to "C" Residence District, to—wit:
Lots 5, 6, '7, Block 2, J. A. Humphreys'
Subdivision A, St Paul, Minn. , and
vacated alley accruing to said lots at
approximately 1748 East Montana Avenue;
situate on property located on the south side of East
Montana Aven.ue between Flandrau Street and White Bear
Avenue in the City of Saint Paul.
Section 2. This ordinance shall take effect and be in `
force thirty (30) days from and after its passage, approval
and publication.

first parties and James J. Danek and Pearl C. Danek� husband and wife,
Richard W. Rahif and Dolores E. Rahlf, husband and wife, Kenneth A. Hansen
and Adeline R. Hansen, husband and wife, Daniel DePalma and Michiko DePalma,
. husband and wife, John F. Darwitz and Dorothy V. Darwitz, husband and wife,
Ben Gleeman and Evelyn Mae M�alani , single, second parties.
WHEREAS first parties are the owners of lots 5, 6 and 7, Block
2, J. A. Humphrey's Subdivision A and vacated ailey accruing to said
lots, Ramsey County, Minnesota, which are zoned as Residential "A" in
the City of St. Paul .
AND WHEREAS first parties propose to erect an apartment building
which will require a rezoning thereof to a Residential "C" district. ,

AND WHEREAS second parties are the owner of single residence
dwelling homes in said Block 2, adjacent to and nearby said lots 5, 6
a�d 7, and are willing to aid first parties in said rezoning from Residential
"A" to Residential "C", upon conditions hereinafter set forth, and will
join in first partles' petition for such.rezoning thereupon.
IT IS THEREFORE AGREED by and between the parties hereto
as follows:
1 . That as a condition of said rezoning� first
party agrees with second parties artd will agree with the
City of St. Paul to erect a storm sewer at or near the
southwest corner of said lot 7 to connect with the

trunk sewer on Montana Avenue at his own cost and
expense and will construct such storm sewer in the
manner and to the specifications approved by the
City of St. Paui Engineering Department so that said _

waters collected or deposited in the area surrounding
� satd lot 7 and the properties of second parties.
2. That said storm sewer wili be constructed
and installed on said lot prior to the development or
construction of any apartment building on said lots
5, 6 and 7, and appropriate easements for the permanent
maintenance and use of such sewer.
3. First parties further agree that if such
rezoning is granted and said storm sewer is not promptly i
constructed, the City of St. Paul shall be and is '
authorized to construct same and shall have necessary
easements therefor, and that the cost of same ,
shall be a lien upon said lots 5, 6 and 7 only and second
parties shall be held harmless ahd be indemnified
from any costs or assessments therefor.
4. First parties further agree that in the con-
struction of such apartment building on said lots 5, 6
and 7, all driveways and access thereto shall be on the
east side thereof and that no driveways, sidewalks or
other access for ingress or egress for any purpose

Dear Mr. Marshall:
This letter refers to the petition of Joseph P. and Joyce L. Lombardo
to rezone from "A" to "C"' Residence property located on the south side of
East Montana Avenue, between Flandrau Street and White Bear Avenue. This
property is further described as follows:
Lots 5, 6, 7, Block 2, J. A. Humphrey's Subdivision A,
and vacated alley accruing to said Lots at approximately
1748 East Montana Avenue.
The petitioner proposes to develop the site with a 12-unit apartment
building.
This matter was considered at the June 5 and 19, 1969, Board of
Zoning meetings. The staff reported that the proposal would provide a
good land use progression from Commercial to parking to multi-family to
single-family use and that a 23-unit apartment building exists across the
street from the site. The staff also noted, however, that this proposed
construction represents further encroachment into a low-density
residential area and that the Comprehensive Plan calls for low-density
residential use of this property.
The Board discussed with Mr. Lombardo, the petitioner, and Mr. Kenneth
Hansen, a neighborhood resident, drainage problems of the block and a
possible agreement between the parties whereby the petitioner would install
a sewer to alleviate the water problem. At the June 19, 1969, meeting a
letter from the Public Works Department was presented indicating their
conditional approval of the proposed sewer plans.
Subsequently, the Board of Zoning voted 5-0 to recommend approval of
this petition to rezone from "A" to "C" Residence, subject to the conditions in
the June 11, 1969, letter from the Public Works Department.

This letter is to inform you that the Sewer Department of the City of
St. Paul has no obje.ctions to the proposed plans of Mr. Lombardo, providing
the following conditions are met:
l .) That Mr. Lombardo construct a suitable drain system whereby he is
to drain only that water which accumulates in the area as tne land
stands in its present condition. .
'2.) That storm•water runoff as a result of any improvement made by
Mr. Lombardo is to be directed out onto Montana Avenue.
' 3.) That all roof drainage be directed onto the ground and then over-
land onta Montana Avenue.
In addition to the above, this Department atso is of the opinion fihat
an 8" clay tile pipe should be used to provide the necessary drainage from
the proposed catch basin to the existing sewer as stipulated in 1 .) above.

Council (�►ambers of Che Court House aad City Hall in the City of
St. Paul at 10:00 a.m. on July 10, 1969 on the petition of Joseph
P. and Joyce L. Lombardo to rezone from Class "A" Residence District
to Class "C" Residence District on ehe following property: Lots 5,
