Dear Mr. Marshall:
This is written in response to the petition of Julia Caron to rezone from "C"
Residence to Commercial, property located on the north side of Sherburne Avenue
between North Snelling Avenue and Asbury Street. This property is further
described as:
Lot 13, Block 3, Lyman D. Baird 's Addition.
The Board of Zoning considered this petition at its regular meeting on
October 2, 1969. Reporting to the Board, the staff noted that the proposed use
of part of the property was to provide an off-street parking lot. The property
has a frontage on Sherburne Avenue of 40 feet and an area of 4,900 square feet.
The site is occupied by a one-story, non-conforming retail building with an
unuseable garage in the rear. The staff noted that the Comprehensive Plan calls
for high-density residential use of the property and also noted that the non-
conforming status has existed for 47 years and this use should be phased out as
the existing structure is deteriorating.
Mr. Louis G. Altman, representing the petitioner, said that the Commercial
building will remain but the old garage in the rear would be removed to provide a
parking area.
Mr. Merrill Robinson, representing Hamline Community Association, noted that
their organization is opposed to any Commercial encroachment onto their residential
areas.
Subsequently, the Board of Zoning moved to recommend approval of this petition
to rezone the property from "C" Residence to Commercial to allow improvement of the
property. The motion for approval was passed by the Board by a vote of 5-0.

on Thursday, �ctober 2, 1969� at 2:00 P,M,
PRESENT: Messrs. Ames, Cohen, Gadlex, Gauger, McPartlin, and�Maietta of
the Board and Messrs. Brown and Sorenaon and Mrs. Frantzen of
the ataff. Mr. McPartlin voted on the Dykema, Spannaus. Hirte,
Cukier, and Caron matters becauae Pir. Gauger had not yet arrived.
JULIA CARON: A petition to rexoue from "C" Reai�ence to Cammercial Dietrict
property located on �he �aorth side of Sherburne Avenue between North Snelling
Avenue and Asbury Street for the purpose of an off-street parking lot.
Mr. Sorenson ae�narized the staff report sts�ing that there is no history for
thia site which has a 40-foot lot with a depth of 124 feet and an axea of
4,960 square feet. The frontage along 5nelling Avenue is zoned Ca�ercisl;
south is zoned Caam►ercfal; and east and north is zoned "C" Residence. The
Comprehensive Plan recommends high-density reaid�ential development for the
; site and the adjacent area. The site is occupied by a oae-story non-
conforming retail building with an old unusable gar�ge in the rear. Staff
conclusions also noted the proposed rezoning may have a detrimental effect
on the residential property to the east �nd th�t �the non-conforn�ing atatus
of the property has exis�ed €or �7 years. Th�ts status is not an indication
that the property should now be zoned Caaffaercial, but rather that the
deteriorating co�e�cial use should now be eliminsted.
Ae passed around a picture of the property to the �oard m�mbers.
A�Ir. Maietta wanted to know that since it is zoned 'i�" Residence, couldn't it
be naed for parking. Mr, Sorenson said for resirlentfal parking only; not
commercial,
Mr. Louis G. Altman, representing the pe�itionerm submitted a picture af the
driveway, of the front of the store. and of the property ecroas the street.
He said the old garage in the rear wfll be removed to allow for parking.
