WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in
the City of Saint Paul; and

5 WHEREAS, §29311 provides for the granting of variances from the sound level limitations contained in
6 §293.09, upon a finding by the City Council that fuil compliance with Chapter 293 would constitute an
7 unreasonable hardship on an applicant, other persons or on the community; and
9 WHEREAS, Lametti and Sons, Inc., represented by Dan Banken, Project Manager, who has been designated
10 as the responsible person on the applications, has applied for a variance to allow work on the relining of City sewers
11 in the general vicinity of the following addresses: 2220 Jefferson Avenue, 595 Hartford Avenue, 1354 Edcumbe
12 Road, 603 Mount Curve Boulevard, 2019 Scheffer Avenue, 2091 Scheffer Avenue, 2119 Scheffer Avenue, 2149
13 Scheffer Avenue, 2211 Scheffer Avenue, 647 Cleveland Avenue South, 665 Cleveland Avenue South, 514 Hamline
14 Avenue South, 1219 Niles Avenue, 1275 Niles Avenue, 1338 Niles Avenue, 1040 Hubbard Avenue and 417

WHEREAS, applicant is seeking a variance far the period of twenty four to forty eight hours at each of the
above locations; and
WHEREAS, if applicant is not ganted a variance it will not be able to reline sewers for the City of Saint
Paul, Project 03-5-1918; and
WHEREAS, the Office of License, Inspections, and Environxnental Protection has reviewed the application
and has made recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Lametti and Sons,
subject to the following conditions:
1) The variance shall be for a twenty four to forty eight hour window at each of the
specified locations from November 1, 2003 to January 10, 2004.

2) Lametti and Sons, Inc. Shall take all practical steps available to minimize the noise
levels during this period including operating the majority of the pumps between the
hours of 7:00 A.M. and 10:00 P.M.
FURTHER RESOLVED, that any violation of the condirions set forth above on any of the dates may result
in revocation of the grant of a variance for the later dates, in addition to any criminal citation which might issue.

City Sewer Re-Lining Work, Various Locations
Attached is a sound level variance application from Dan Banken, Project Manager representing Lametti &
Sons, Inc., 16028 Forest Blvd. N., P.O. Box 477, Hugo, MN 55038 to allow work on the re-lining of City
sewers at numerous locations around the City of Saint Paul.
The work will be done at or near these addresses:
