Ke11y, Mayor I500 Rice Street Telephone: 651-55&2255 SaintPaubMinnesota55117 Facsimil¢:651-558-2237 www.cislpauLmn.us/depts/parks T1Y.� 651-2666378 Saint Paul Munici�al Athletics S�ecial Event Contract WHEREAS, the 2003 Saint Paul Winter Carnival Softball On Ice Tournament is scheduled to take place on February l, 2003, and February 2, 2003 on Lake McCarrons; and WI�REAS, the event is sponsored by the St. Paul Municipal Athletics Department, and as part of the event it is necessary to have a site to maintain a bracket board, haue umpires and participants check in, and conduct other organizational activities; and WHEREAS, Dean's Tavern is an estabiishment near the site which is large enough to serve as the headquarters, and is willing to serve as the host site and Tournament Headquarters for the event, now therefore, the parties agree as follows: 1. That Dean's Tavern wiil seroe as host site and Tournament Headquarters for the 2003 St. Paul Winter Carnival Softball on Ice Tournament, which shall include providing space for the Tournament Bracket Board, and serving as a check-in site for officials and participants in the event. This agreement shall be in effect during the following dates and times: Thursday, January 30, 2003 Saturday, February 1, 2003 Sunday, February 2, 2003 5:00 p.m. - 8:00 p.m. 8:00 a.m. - 6:00 p.m. 9:00 a.m. - 4:00 p.m. 2. That in recognition ofthe fact that serving as the Tournament Headquarters will result in an increase in business from participants and spectators at the event, Dean's Tavern agrees to pay 8% of the total revenues collected by it during the days and times listed above to the City of Saint Paul. 3. That Dean's Ta�ern agrees to defend, protect, indemnify and hold harmless the City of Saim Paul, its officers, agents and employees against any and all claims, suits, judgments or actions of any character on account of any injuries, damages or losses received or sustained by any person or party arising out ofthe use ofthe premises ofDean's Tavern during the dates and times ofthe event, except to the extent that any such damage is directly attributable to any negligence on the part of the City. 4. Dean's Tavern will provide a certificate of general liability insurance listing the City of St. Paul as an additional insured, in amounts not less than $300,000 per claim and $1,000,000 aggregate.
