03-912CouncilFile# d3 Green Sheet # 3�� � �� Presented By RESOLUTION CITY OF SAINT PAUL, MINNESOTA �7 Referred To Committee: Date 1 2 WHEREAS, in Council File No. 02-I115, the Council of the City of Saint Paul duly 3 adopted an intezim ordinance approving a moratorium of limited duration for the purpose of 4 studying land uses in the Sunray azea; and 6 7 9 10 11 12 13 14 15 16 1� 18 19 20 21 22 23 WHEREAS, the Council desires now to amend Council File No. 02-1115 to the extent necessary to enable the developers of real property commonly known as the Posey Miller site located at 1721, 1727 and 1729 Old Hudson Road in order to move forwazd with their various zoning and building applications which would otherwise be prohibited under the terms and conditions set forth in Council File No. 02-1115; and WHEREAS, the proposed use of the said ]and proposed by developers is a desirable use within the present and future context of land uses in the Sunray Area; NOW, 'I'HEREFORE, BE IT RESOLVED, that Council File No. 02-1115, should be amended to pernut new development at 1721, 1727 and 1729 Old Audson Road to allow the developers of the said land to apply for and, if approved, receiving any zoning or building permits necessary to undertake the construction of their proposed development; AND, BE TT F[JRTHER RESOLVED, that pending the official amendment of Council File No. 02-1115, the developers of 1721, 1727 and 1724 Old Hudson Road shall be permitted to apply for and, if approved, receive the zoning or building pernuts necessary to undertake the construction of their proposed development; AND � z 3 4 5 6 7 8 9 10 03 9l� BE TP F[JRTHER RESOLVED, that in the event Council File Na 02-1115 is not amended to provide the developers with the approvals and pernvts they seek, that the developers of 1721, 1727 and 1729 Old Hudson Road acknowledge that they proceed with their affairs at their own risk; AND BE TT FTNAI_I,Y RESOLVED, that the planning and zoning administrators shall be provided with a copy of this resolution upon its adoption and approval.
