WHEREAS, Dakota Cooks, LLC d!b/a Dakota, located at 1021 Bandana Boulevard in
2 Saint Paul, has requested a waiver of the 45-day notice requirement for issuance of on-sale
3 liquor and Sunday on-sale liquor licenses; and

5 WHEREAS, the District 10 Community Council has agreed to the waiver of the notice
6 requirements; and
8 WHEREAS, the Council finds that the application is in order and there are no grounds for
9 denial of the licenses and that failure to grant the waiver and the consequent delay in approving
10 the licenses would cause exceptionai and unusual hardship to the license applicant; and

WHEREAS, the licensee agrees that in the event a complaint is received prior to the
expiration of the 45-day period and the complaint provides a basis for adverse action against the
licenses, that the Office of License, Inspections and Environmental Protection may direct the
licensee to immediately discontinue ali operations until a public hearing is scheduled, and that
the licensee shall comply with said directive; now, therefore, be it
RESOLVED, that the 45 day notice requirements of §409.06 of the Saint Paul Legislative
Code aze hereby waived and on-sale liquor and Sunday on-sale licenses are issued to Dakota
Cooks, LLC dlbla Dakota, for the premises located at 1021 Bandana Boulevard, subject to the
agreement stated above.

Dear Ms. 3chweinler,
On December 3, 2002 the Executive Commi[tee of the District 10 Community
Council voted to approve the waiver of the 45 day notification process as it pertains to
Mr. Richard Ericksons application for a liquor license at the Dakota Baz and Grill, 1021
E. Bandana Boulevard.
The Dakotah has been a wonderful part of our neighborhood for quite a few years,
the Boazd encourages L,IEP to do everything possible to ensure it's continuing presence.
