The matter of the appeal for 516 St . Peter St. was contiriuecl Uy
Arthur Murray and Solomon Miller. Rabbi Miller and Mr. Murray werc
presented with a copy of the Health Department inspection rel�ort
dated September 19 , 1969 , which they were given some time to look
over. Rabbi Miller presented his proposal to accommodate t}ie
Housing Code requirement that each apartment must have its owi�
bathroom.
Mr. Tieso moved that a 2-week extension of time be granted Rabbi
Miller in order to :
1 . Formulate a new proposal on how to accommodate
the requirement that each apartment must have
its own bathroom, and
�2 . Devise a plan to correct the deficiencies
indicated in the Spetmeber 19 , 1969 Health
Department survey.

appealed the August 12 , 1969 Bureau of Health letter itemizing

Mr . Cohen moved that the appeal be extended for a periocl of one
month to allow Sister Breault an opportunity to explain to }�er
father the alternatives available in this matter in order that a
path of action may be taken.

Mr. Butz paid the $5 . 00 filing fee.
Mr. Butz pointed out that the address being. appealed was 1443 tiewitt
and not 1433 Hewitt.
Mr. Butz appealed the letter of the Building Department dated
September 17 , 1969 stating that a building permit cannot be issued
for a dormer addition on the second floor of 1443 Hewitt l�ecause
of insufficient ceiling height. ,
Mr. Cohen moved that Section 34 . 01-1 (b) of the St . Paul Le�;islativc
Code relating to habitable rooms and stating :
"Such rooms shall not be less than seven (7) feet
wide exclusive of closet spaces , and shall contain
not less than ninety (90) square feet of gross
floor area exclusive of closet spaces. Such rooms
shall have a clear height of not less than seven (7)
feet six (6) inches for at least sixty (60) squarc
feet of floor area. "

Department stating that a building permit cannot be issuecl for con-
struction of the proposed swimming pool enclosure at 1964 Uni.veY•sity
Ave . , as the proposed addition would be over the 5 ,000 square leet
allowable fire wall area.
Mr . Tieso moved that Section 4 . 06-1 relating to area restrictions
for new buildings be waived for 1964 University Ave. in orcler to
allow construction of the proposed swimming pool enclosure as in-
dicated in the plans which were submitted to the 13uilding Depart-
ment . Such waiver is to be granted on the condition that all

recommendations of John Talbot , Chief Fire Prevention Inspector,
concerning the proposed construction, be agreed to by the Building
Department and complied with in all respects , in the construction
of said swimming pool enclosure.
