Dear Mr. Marshall:
This is written in response to the application of Top Sales, Inc. for a permit to
install a self-service car wash on the north side of West Maryland Avenue between
Mackubin and Norton Streets. This property is further described as the east 127.40
feet of the south 157.45 feet of Lot 39, Cottage Homes.

The Board of Zoning considered this matter at its regular meeting on October 2,
1969. The staff reported that this property was rezoned to Commercial on May 2, 1964.
The plan meets the design standards and provides for buffer areas along the east and
west property lines, and is maintaining the proper setback. The Traffic Engineer has
reviewed the plan and recommends approval. The Traffic and Accident Section of the
Department of Public Safety has not reported on this matter at this time.
Two area residents spoke in opposition to the application. Mr. Michael Cramer
described the character of Norton Street as being developed with many duplexes and a
large number of children, and noted that the proposed car wash could endanger the
life and limb of these children. Mr. Orville Schroeder expressed concern with an
all-night operation and no caretaker. A problem with trash and excessive running
water could be created. One letter in opposition was also noted.
Mr. Bob Martinson, the applicant, stated that trash is picked up in the morning
and afternoon, and a chain link fence will enclose the area. He stated that this
operation would be one of the better ones in the city, being the same as two others
he operates in Ramsey County.
The Board discussed the matter at length giving consideration to the hours of
operation and the traffic problems that might be created. It was moved to lay over
the matter until the next Board of Zoning meeting to receive a definite report from
Captain Anderson of the Police Department. The Board voted 5-0 to lay over the matter .
At the Board of Zoning meeting on October 16, 1969, the staff reviewed the report
as previously given and read a letter from Captain Anderson of the St. Paul Police
Traffic and Accident Section. Captain Anderson anticipated that the car wash would
not create any serious traffic hazards. However, any increase in left-turn movement
onto or from Maryland Avenue would tend to increase the accident potential. The
staff suggested the plans be revised showing the structure relocated 20 feet to the
north and indicating the overall slope of the site be from the north to the south.
Mr. David Peterson, attorney representing the applicant, stated that the peak
hours of operation are from 6 to 10 p.m. and that the applicant would cut back on the
hours of operation if the Board makes such a recommendation.
It was the findings of the Board of Zoning that the hours of operation be limited
from 8 a.m. to 11 p.m. and that plans be submitted incorporating the changes recommended
by the staff. Consequently, the Board recommended approval of the application ;;by a
