WHEREAS, The C rch of Saint Matthew, 5�7 Hall Avenue, Saint Paul , Minnesota,
55107, has experienced substantial fire damage to the extent that the existiag
structure had to be demolished; and
WHEREAS, The Church of Saint Matthe��_ is at the present time constructing a
new church structure at the intersection of Robie Street and Hall Avenue; and
WHEREAS, The presence of a substantial amount of heavy construction
equipment and materials that are necessary to develop the new church make it unsafe to
use Hall Avenue generally from Robie to Winifred Streets for roadway purposes.
WHEREAS, The safiety, health and welfare of the general p�btic would be served
if Hall Avenue generally from Robie to Winifred Streets was temporarily closed for
a reasonabie period of time.
NOW, THEREFORE, BE IT RESOLVED, That the Church of Saint Matthew is hereby
authorized and permitted fihe use of Hall Avenue between the east property line and
the west curb line of Hall Avenue, and between the north property line of Robie
Street and the projected north line of Lot 3, Block 78, of West Saint Paul Proper
Addition to Saint Paul , which is 150 feet northerly of the north property line of
n� �,� Robie Street, subject to the rights of the Sheehy Construction Com(�any, as described
���� ' in Department of Public Works Permit for use of Street, No. 2112, dated May 13, 1969.
- This said permit to e�cpire on June 10, 1g70, unless rescinded or amended before that
date at the discretion of the Ccx�nis�toner of Public Works.
F�JRTHER R�SOLV�D, That the Commissioner of Public Works is hereby authorized to
issue a permit to said Church of Saint Mattk►ew for the use of said street upon and
subject to the folla�ring provisions; terms and conditions:
1 . That saic! permittee shall pay the cost of pubiication of this
Resolution.
2. That said permittee shall ailaN for uninterrupted pedestrian traffic on
the westerly sidewalk of Hall Avenue and furnish and install and pay
for directional signing as directed by the Traffic Bureau of the
Department of Public Works.

3. That said permittee shall not allow parking of private automobiles
on temporarily ciosed Hall Avenue.
4. That said perrt�ittee shall not aliow this real property, dedicated for
roadway use, to be used as a playground area.
5. That said permittee shall notify the Traffic Bu�eau of the Department
of Public Works when the street is requested to be closed and opened;
all expenses incurred by the Departrnent of Public Works or the permittee
in administration, furnishing, installi�g and removing of barricades,
signs and other control devices, shall be paid for by the permittee,
and expenses incurred by the Department of Public Works shall be
accounted for under Department of Public Works Project Number E-1045.
6. The permittee shall furnish, install, maintain and pay for all necessary
safety and warni�g devices, including ftashers as directed by the
Traffic Bureau of the Department of Public l�iiorks.
7. Tl�t said p�r�i.ttee shall furn'rsh a bo�d o# $1�,000.00 to tt�e City of- ---
Saint Paul , conditioned to co�ply with all the ter�as of this Resolution
and to indemnify and save the City harmless from any and all loss,
liability, judga�ents, suits, costs, charges, da�aag�s or expenses that
�nay accrue to person or property occasioned by the use of said street.
8. That said permittee expressly agrees and undertakes to fully indemnify
and hold harmless the City of Saint Paul , its agents, officers and
employees, fro� any and all dart�ages, claims, losses, judgments, suits
or expenses arising out of or occasioned by the use of said street
conternplated by this permission and authority.

9. That said permittee shall not proceed to use said street or be issued
a permit uniess and until said permittee shall procure and furnish to
said City, public liability insurance covering itself and including
the City of Saint Pawl as co-insured against a�y liability on account
of injury to person or property arising out of or resulting from tMe
use of said street in an amount of $250,0�0.00 on account of personal
injury resulting from any one accident and affecting more than one
person, and in the amount of $2�0,000.00 because of injury or damage
to property on account of any one accident, such insurac�ce coverage to
be evidenced by policies of insurance approv�d by the Corporation
Counsel .
10. That said permittee shall file its written acceptance of this
Resolution and of all the provisions, terms and conditions of
the same with the City Clerk and shall submit to the Co�poration
Counsel for his approval , the aforesaid bond and insurance coverages
which shall thereafter be filed with the Comptroiler of the City of
Saint Paul not later than 15 calendar days after Council approval of
this Resolution, and in the event of its failur� to do so, the
permission and authority hereby granted shall lapse.
