2 RESOLVED, that the Tree Trimmer and Vehicle License held by Thomas Walsh d/b/a
3 Expert Tree & Landscaping (License ID Number 19980002135) is hereby suspended
4 immediately for failure to submit proof of current general liability insurance with an expiration
5 date that coincides with the expiration date of the license. Said suspension shall be in effect until
6 such time as the licensee submits proof of current general liability insurance with an expiration
7 date that coincides with the expiration date of the license and written notice of the lifting of said
8 suspension has been provided to the licensee by the Office of License, Inspections and
9 Environmentai Protection.

11 This Resolution and the action taken above are based upon the facts contained in the January
12 2, 2003 Notice of New Violation letter to the licensee. The licensee did not respond to the
13 Notice ofNew Violation letter.

Please take notice that this matter has been set on the Consent Agenda for the Council
meeting scheduled for 3:30 p.m., Wednesday, February 5, 2003 in the City Council Chambers,
Third Floor, Saint Paul City Hall and Ramsey County Courthouse.
Enclosed are copies ofthe proposed resolution and other documents which wiil be presented
to the City Council for their consideration. This is an uncontested matter, in that the facts concerning
the failure to submit proof of current liability insurance have not been denied. As indicated, this
matter has been place on the consent agenda portion of the City Council meeting during which no
public discussion is allowed. The recommendation of the license office is for the immediate
suspension of your license until proof of current liability insurance, with an expiration date that
coincides with the expiration date of your license, has been submitted to and approved by to the
licensing office.

RE: Tree Trimmer License held by Thomas Walsh, d/b/a Expert Tree & Landscaping for the
City of Saint Paul
License ID #: 19980002135
Dear Mr. Walsh:
The Office of License, Inspections and Environmental Protection has notified us that you
have now paid your 2002-2003 license fees. We have, therefor, canceled the matter from
consideration by the City Council on Wednesday, January 8, 2003. However, on December 3,
2002, the licensing office sent you a notice requiring that you submit proof of cunent general
liability insurance with an expiration date coinciding with the license expiration date of 7une 18,
2003. This information was due by December 17, 2002. No insurance information has been
received as of this date. Therefor, the licensing office has recommended that adverse action be
taken against your Tree Trimmer License for this new violation.
As with the previous violation, if you do not dispute that the insurance information has
not been submitted, please send me a letter admitting the violation. The matter will then be
scheduled for a hearing before the Saint Paul City Council to determine what penalty, if any, is
appropriate. You will have an opportunity to appear before the Council and make a statement on
your own behalf. The recommendation from the licensing office is for the immediate suspension
of your Tree Trimmer license until proof of current general liability insurance information has
been submitted to and approved by the licensing office. You may also submit proof of current
general liability insurance to the licensing office immediately to take care of this matter.
If you wish to dispute the new violation, you are entitled to an evidentiary hearin� before
an administrative law judge. If you wish to have such a hearing, please send a letter statin� that
you are contesting the facts. You will then be sent a notice of hearing with the date, time and
place for the hearing, the name of the administrative law judge, and an explanation of the
procedures.

Please let me know in writing no later than Monday, January 13, 2003, how you wish to
proceed. If you have not contacted me by Monday, January 13, 2003, I will assume thaf
you are not contesting that the required insurance information has not been provided. I
will then schedule this matter for the St. Paul City Council and have it placed on the
Consent Agenda during which no public discussion is allowed and the recommended
penalty will be imposed.
