FLANAGAN, JR. , 1812 Oakdaie Avenue , St. Paul, Minnesota, 55118, hereinafter referred to as "Consul- tant" ; WIiEREAS , City has entered into an agreement with the U. S. Department of Housing and Urban Development for the pur- pose of developing an Integrated Municipal Information Hu�an Resource Development Subsystem; and WHEREAS , Said agreement contemplates the City providing services as part of the research and development contract , and that the City and Consultant desire to enter into an agreement �providing that Consultant shall furnish certain professional ad- vise and consultation to the City for the duration of the City ' s pro3ect ; .. NOW, THEREFORE, IT IS HEREBY AGREED BY AND BETjdEEN . THE PARTIES HERETO AS FOLLOWS : 1. Consultant , for the consideration herein and here- inafter set out , agrees to provide professional services to the City for its development of an Integrated Pdunicipal Information Human Resouxce Development Subsystem, as set out and more parti- cularly described in Contract A-121� , effective March � , 1970 , by and between the City and the Department of Housin� and Urban Development , under the direct supervision of the City' s Pro�ect Director. Consultant, upon the request of the City, and more particularly, the request o£ the Cit,y' s Pro�ect Director, shall nerform the work assigned. ' r- � . . . !„ a...,,,y ' � �� , � 2. For profe$sional consultant services provided pur- suant to t�his agreement , City agrees to compensate Consultant on the basis of Twenty-Five Dollars ( $25 .00) per each half day of work, and the sum of Fifty Dollars ( $50.00) for each day of work; provided however that the total sum paid in 197o shall not exceed Four Thousand Dollars ( $4 ,000 . 00) and shall not ex- ceed Three Thousand Dollars ( �3 ,000 . 00) in 1971 . Consultant may submit. monthly itenized statements to the City' s Pro,ject Director, and the City shall pay the amount set forth therein after it has been approved by the said Pro�ect Director. 3. This agreement may be terzninated by either City or Consultant, at any time and for any reason whatsoever, upon the giving of the other party thirty ( 30 ) days written notice thereof. 4. During the term of this agreement Consultant shall not be considered as an employee of the City and shall be enti- � tled to none of the benefits usually accorded to a re�ular City employee including but not limited to such items as sever- ance pay , health and welfare insurance benefits , retirement credits , Workmen ' s Compensation coverage or other benefits nor- mally considered to be employee frin�e benefits for any regular City employee . 5 . Consultant shall be deemed an independent contractor for the purposes of this agreement and shall not be sub3ect to any existing Civil Service provision, protection or benefits accorded to a regular City employee and said Consultant hereby expressly waives all rights to benefits accorded to present City . e�Fl�oyees and ��r�by �cknowledges tr.At ::� is entitled to �ar.e no claim a�ainst the City except for compensation for services _2_ r_ . ,. , � . . . .,., � . . �,... , , • � rendered as herein provided.
