BE IT RESOLVED, that, upon the petition of Darcy and Ann Tinnes, as documented in Real Estate
Division File Number 08-2003, public properties hereinafter described are hereby vacated and
3 discontinued as public property:

5 The property to be vacated is described as follows:
7 that part of the alley in Block 21, Lane's Highland Park lying westerly of the northerly extension
8 of a line 33 feet easterly of and parallel to the east line of Lot 24, said Block 21

10 BE IT FURTHER RESOLVED, that, subject to the herein stated exceptions and with the
11 accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily on behalf of Qwest
12 Corporation, Northern States Power Company. d.b.a. Xcel Energy, District Energy St. Paul,
13 Incorparated, MCI, Inc., Comcast of Saint Paul, Inc., Saint Paul Regional Water Services, and the
14 Department of Public Works, made a part hereof by this reference and filed in the office of the City
15 Clerk of Saint Paul, the City, for itself and on behalf of these corparations and departments, waives the
16 right to the utility easements in that part of the vacated area described below:

18 that part of the south half of the alley in Block 21, Lane's Highland Park lying westerly of the
19 northerly extension of a line 19 feet easterly of and parallel to the east line of Lot 23, said Block
20 21 and easterly of the northerly extension of a line 11 feet westerly of and parallel to the said east
21 line of the Lot 23.

23 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
24 Saint Paul Legislative Code as amended, and to the following conditions:

26 1. That the petitioner's, their successors and assigns shall pay $600 as an administrative fee for this
27 vacation which is due and payable within 60 days of the effective date of this resolution.

29 2. That any improvement in the vacated property shall not interfere with, or prevent access, for the
30 purpose of maintenance, repair, upgrade or replacement, to the existing utility facilities. Should
31 any improvement in any way interfere with ar prevent access to the said facilities, the petitioners
32 or their successors shall provide new easements as may be required, and shall assume all costs of
33 relocating facilities to the new easements.

1 3. That the petirioners, their successors and assigns agree to indemnify, defend and save harmless
2 the City of Saint Paul, its officers and employees from all suits, acrions or claims of any character
3 brought as a result of injuries or damages received or sustained by any person, persons ar
4 property on account of this vacarion or petitioners' use of this properly, including but not limited
5 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
6 because of any claims or liability arising from any violation of any law or regulation made in
7 accordance with the law, whether by the petitioners or any of their agents or employees.
9 4. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
10 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
11 and shall, within the period specified in the terms and conditions of tl�is resolution, comply in all
12 respects with these terms and conditions.

new easements as required and the petitioner or its successor shall assume all costs of relocating
facilities to the new easements.
