WI�REAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subj ect of
noise in the City of Saint Paul; and

WIlEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in
§293.09, upon a fmding by the City Councii that full compliance with Chapter 293 would constitute an
unreasonable hazdship on an applicant, other persons or on the community; and
9 WHEREAS, Daniel Burns, homeowner, who has been designated as the responsible person on the
10 application, has applied for a variance to allow amplified music at 230 South Mississippi River Boulevard, on
11 September 27, 2003; and

13 WHEREAS, applicant is seeking a variance for the hours of 8:30 pm. to midnight on September 27, 2003;

WHEREAS, if applicant is not granted a variance he will not be able to hold a wedding reception; and
WHEREAS, the Office of License, Inspections, and Environmentai Protection has reviewed the application
and has made recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Daniel Burns, subject to
the following conditions:

The variance shall be for the hours of 8:30 p.m. to midnight on September 27, 2003.
All electronicaliy powered equipment used in conjunction with the event shall not
exceed 90 dBA from 830 p.m. to 10:00 p.m. and 85 dBA from 10:00 p.m. to
midnight as measured from the inside tent wall opposite the noise source.

3) The applicant shall provide personnel and equipment who shall provide continuous
sound level monitoring between 8:30 p.m. and midnight on the date to ensure
compliance with Condition #2.
4) All electronically powered equipment, PA systems, loudspeakers, or similar devices
shail be tumed off no later than midnight on the date_
5) The speakers shall be directed away from neighboring residents and in the direction of the
Mississippi River.

Attached is a sound level variance application from Daniel Burns, Homeowner at
230 Mississippi River Blvd. S., Saint Paul, 55105, to allow amplified music played by a
disc jockey under a tent during a wedding reception being held at that address. A variance
is requested from 8:30 p.m. to 12:00 midnight on September 27-28, 2003.
