WHEREAS, Dayton's Bluff Neighborhood Housing Services, (Zoning File # 03-292-365) has submitted for City Council
approval the attached preluninary and final plat for subdivision of proper[y at the northeast comer of Payne Avenue and
Hopkins Street to create eight (8) townhouse lots and one (1) common lot to provide for eight (8) dwelling units; and
WHEREAS, the appropriate City depariments have reviewed the plat and found, subject to the recommended condirions, that
it meets the requirements of Chapter 67 of the Zoning Code; and
WHEREAS, norice of a public hearing before the City Council was duly published in the official newspaper of the City and
norices were mailed to each owner of affected property including all proper[y situated within 350 feet of the subject property;
and
WHEREAS, the City Council held a public hearing on the proposed plat on _lugust 27, 2003, where all interested parties
were given the opportunity to be heazd and the Council considered all the facts and recommendations concerning the plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached preliminary and fmal plat
for NEIGHBORHOOD HOUSING PAYNE AVENUE TOWNHOMES FIRST ADDITION at the northeast comer of Payne
Avenue and Hopkins Sireet subject to the following condirions:
1. The City Council approves the necessary street vacaUons;
2. The applicant shall follow the recommendations of the Ramsey Soil and Water Conservarion Dishict duxing
and after conshuction and these recommendations sk�all be agreed to as part of site plan review; and
3. The applicant shall file a copy of the Council Resolurion approving the plat with the Ramsey County
Recordex's Office.

PARCEL SIZE: 21,142 sq. ft. (.485 acres)
EXISTING LAND USE: the site is vacant except for one billboard.
SURROUNDING LAND USE: Swede Hollow Park is immediately east; residential and
commercial mixed uses are located to the south and west. Property to the north is vacant.
E. ZONING CODE CITATION: §67.301 states that platting is required when a subdivision (1)
creates five or more lots or parcels each of which is 2'/z acres or less in size, or (2) requires
paved streets, alleys and other public improvements, or (3) is previously unplatted land.
§67.406 provides criteria for review of subdivisior applications. These criteria are covered
below under "Required Findings."
F. HISTORY/DISCUSSION: Zoning File # 03-268-224- on June 18, 2003, the City Council
approved rezoning a portion of this property from RT-2 to RM-2 to permit this development.
This ordinance was published in the Legal Ledger on July 3, 2003. Applicants have also
filed petitions for necessary street and public property vacations (files # 04- and 04A-2003).
G. D1STRICT COUNCIL RECOMMENDATION: None received.
H. REQUIRED FINDINGS: § 67.406 of the Zoning Code requires that all of the foilowing
findings shail be made prior to approvai of a subdivision:

1. All the appficable provisions of the Legislative Code are complied with. City staff
have reviewed the proposed plat and have determined that all applicable provisions of
city codes are met. The needed rezoning has been approved and the required streeY
and city property vacation is in process. Site plan review of the� project will be completed
prior to construction.
2. The proposed subdivision will not be detrimental to the present and potential
surrounding Iand uses. The proposed plat is consistent with the surrounding lanc
uses, and wili not be detrimental to present and future use of surrounding land.
3. The area surrounding the subdivision can be planned and developed in
coordination and compatibility with the proposed subdivision. The area
surrounding the proposed plat is already developed or is park and compatible with the
proposed piat.
4. The subdivision is in conformance with the comprehensive plan. The subdivision
is in conformance with the land use chapter of the comprehensive plan, which calls for a
range of housing types and values in all Saint Paul neighborhoods. It also conforms
with redevelopment plans for the area.

5. The subdivision preserves and incorporates the site's important existing natural
features whenever possibte. The site is in a fully-developed part of St. Paul with no •
remaining natural features. Swede Holiow Park is adjacent to the site and the applicant
will work with the city's site plan review staff and Ramsey Soil and Water Conservation
District to protect the park's natural features.
6. AU land intended for building sites can be used safely without endangering
residents by perii from floods, erosion, continuousty high water table, severe soil
conditions or other menace. The site is a flat, fully developed area. The presence of
Swede HoI(ow Park immediately east of the site requires that care be taken during
construction to control erosion.
7. The subdivision can be economically served with public facilities and services.

surrounding streets.
STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends
approval of the final plat for NEIGHBORHOOD HOUSING PAYNE AVENUE TOWNHOMES
FIRST ADDITION in the area bounded by Payne Avenue, Hopkins Street, and North Street
subject to the following conditions:
1. The City Council approves the necessary street vacations;
2. The appiicant shall follow the recommendations of the Ramsey Soil and Water
Conservation District during and after construction and these recommendations shati be
agreed to as part of site plan review; and
3. The applirant shall file a copy of the Council Resolution approving the plat with the �
Ramsey County Recorder's Office.
